Fences are a permitted accessory use in any district and may be erected upon issuance of a Building Permit provided that the fence complies with the following requirements:


By definition, a residential fence is intended to provide for privacy, and/or to protect members of a household, especially children. A residential fence may also secure a private swimming pool against unauthorized entry. Residential fences are usually four to six feet in height. Residential fences are often of the picket, rail, stockade, board-on-board, board & batten, basket weave, or louvered type, and may include chain link fences.

Side and Rear

Residential fences are permitted in the side and rear yards of residential districts. The fence shall not exceed six (6) feet in height, and shall not extend into the front yard or street yard (side yard abutting a street). There are no setback requirements. However, the homeowner is responsible to locate their lot line. No fence shall be located closer than two (2) feet to any alley right-of-way line.

Fences shall not exceed a height of 3 feet when located in the front yard.

Fences shall not exceed a height of 4 feet in a street yard (side yard abutting a street). Fences shall comply with the traffic visibility requirements of Oak Creek Zoning Code Section 17.0401 if a corner lot.

Security fences are permitted, upon the issuance of a building permit, adjacent to the property lines in all districts except residential districts, but shall not exceed 10 feet in height. The Plan Commission shall determine on a case-by-case basis the opacity of security fences, based upon consideration of the need to screen material and upon safety considerations. Security fences shall comply with the traffic visibility requirements of Section 17.0401 of the Zoning Code for corners lots.


Electric fences are permitted in the A-1 Limited Agricultural District and the ER Equestrian Residential District only. Electric fences are permitted adjacent to the lot line and shall not exceed four (4) feet in height in the street yard or six (6) feet in height in the side and rear yard.


Submit your permit application with your plat of survey for your property showing the location of the fence. The fence permit fee is $50 plus a $5 administrative fee. Please allow up to 2 weeks for processing of your permit.

Please note: All fence permit applications are routed to the Engineering Department for their approval pertaining to easements you may have on your property. If any of the fence is located within a drainage or utility easement, you will need Engineering approval and a Signed Condition of Approval. No approvals are given if the easement is within the storm structure.
