The meeting began with the Pledge of Allegiance being said by all present.
Mayor Bolender called the meeting to order at 7:00 p.m. On roll call, the following alderpersons were present: Ald. Kopplin, Ald. Foeckler, Ald. Verhalen, Ald. Toman, Ald. Grabowski, and Ald. Michalski. Also present were: City Administrator Patrick DeGrave, City Attorney Lawrence Haskin, Director of Community Development Douglas Seymour, City Engineer Wayne St. John, City Treasurer Barb Guckenberger, Information Technology Manager Caesar Geiger, Fire Chief Brian Satula, Design Engineer Matt Sullivan (arrived at 8:15 p.m.) and City Clerk Beverly Buretta.
Ald. Grabowski, seconded by Ald. Kopplin, moved to approve the minutes of the 8/6/07 meeting as published. All voted aye; motion carried.
1. PUBLIC HEARING HELD TO CONSIDER PROPOSED AMENDMENT TO SANITARY SEWER SERVICE AREA FOR OAK CREEK AREA, SPONSORED BY CITY OF OAK CREEK AND SEWRPC.
A public hearing was held to consider public comment on, and reaction to, a proposed amendment to the sanitary sewer service area for the Oak Creek area, sponsored by the City of Oak Creek and the Southeastern Wisconsin Regional Planning Commission (SEWRPC). 2. PUBLIC HEARING HELD TO CONSIDER AMENDMENT TO SECTION 17.0332(F)(2) OF MUNICIPAL CODE RELATING TO FRONT YARD SETBACKS FOR NON-RESIDENTIAL BUILDINGS IN NO – S. 27TH ST. MIXED USE NEIGHBORHOOD OVERLAY ZONING DISTRICT.
A public hearing was held to consider an amendment to Section 17.0332(f)(2) of the City of Oak Creek Municipal Code as it relates to front yard setbacks for non-residential buildings in the NO – S. 27th St. Mixed Use Neighborhood Overlay Zoning District. 3. PUBLIC HEARING HELD TO CONSIDER AMENDMENT TO SECTION 17.0501(B)(7) OF OAK CREEK MUNICIPAL CODE RELATING TO BUILDING PERMITS REQUIRED FOR ACCESSORY STRUCTURES.
A public hearing was held to consider an amendment to Section 17.0501(b)(7) of the Oak Creek Municipal Code as it relates to building permits required for accessory structures. A summary transcript is available in the City Clerk’s Office (see item 7 for action on this hearing).

PUBLIC HEARING HELD TO CONSIDER AMENDMENT TO SECTIONS 17.0303 (A-1 AGRICULTURAL DISTRICT), 17.0304 (ER EQUESTRIAN RESIDENTIAL DISTRICT), 17.0305 (RS-1 SINGLE FAMILY RESIDENTIAL DISTRICT), 17.0306 (RS-2 SINGLE FAMILY RESIDENTIAL DISTRICT), 17.0307 (RS-3 SINGLE FAMILY RESIDENTIAL DISTRICT), AND 17.0308 (RS-4 SINGLE FAMILY RESIDENTIAL DISTRICT) OF MUNICIPAL CODE RELATING TO USE OF METAL ROOF MATERIALS FOR PRINCIPAL RESIDENTIAL STRUCTURES.
A public hearing was held to consider an amendment to Sections 17.0303 (A-1 Agricultural District), 17.0304 (ER Equestrian Residential District), 17.0305 (Rs-1 Single Family Residential District), 17.0306 (Rs-2 Single Family Residential District), 17.0307 (Rs-3 Single Family Residential District), and 17.0308 (Rs-4 Single Family Residential District) of the Municipal Code as it relates to the use of metal roof materials for principal residential structures. 5. PRESENTED AND ADOPTED: RESOLUTION NO. 10785-082107, ADOPTING AMENDMENT TO OAK CREEK SANITARY SEWER SERVICE AREA.
Ald. Grabowski, seconded by Ald. Michalski, moved to adopt Resolution No. 10785-082107, adopting an amendment to the Oak Creek sanitary sewer service area. On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, aye. Ald. Verhalen abstained from voting.
6. PRESENTED AND ADOPTED: ORDINANCE NO. 2468 TO AMEND SECTION 17.0332(F)(2) OF MUNICIPAL CODE REGARDING MINIMUM FRONT SETBACKS FOR PRINCIPAL NON-RESIDENTIAL STRUCTURES IN SOUTH 27TH STREET MIXED USE NEIGHBORHOOD OVERLAY DISTRICT.
Ald. Foeckler, seconded by Ald. Grabowski, moved to adopt Ordinance No. 2468 to amend Section 17.0332(f)(2) of the Municipal Code regarding minimum front setbacks for principal non-residential structures in the South 27th Street mixed use neighborhood overlay district. 7. PRESENTED AND FILED AFTER MOTION TO ADOPT FAILS: ORDINANCE NO. 2469 REQUIRING PERMITS FOR ACCESSORY BUILDINGS 120 SQUARE FEET IN AREA OR LESS.
Ald. Grabowski, seconded by Ald. Foeckler, moved to adopt Ordinance No. 2469 requiring permits for accessory buildings 120 square feet in area or less. On roll call, the vote was as follows: Ald. Kopplin, no; Ald. Foeckler, aye; Ald. Verhalen, no; Ald. Toman, no; Ald. Grabowski, aye; and Ald. Michalski, no. Motion failed. Ald. Kopplin, seconded by Ald. Michalski, moved to file Ordinance No. 2469. On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Verhalen, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, aye.
8. PRESENTED AND DIRECTED HELD: ORDINANCE NO. 2470 AMENDING SECTIONS 17.0303(E)(9), 17.0304(E)(9), 17.0305(E)(9), 17.0306(E)(9), 17.0307(E)(9) AND 17.0308(E)(9) OF MUNICIPAL CODE REGARDING PERMITTED ROOFING MATERIALS IN RESIDENTIAL ZONING DISTRICTS.
Ald. Grabowski, seconded by Ald. Michalski, moved to adopt Ordinance No. 2470 amending Sections 17.0303(e)(9), 17.0304(e)(9), 17.0305(e)(9), 17.0306(e)(9), 17.0307(e)(9) and 17.0308(e)(9) of the Municipal Code regarding permitted roofing materials in residential zoning districts. Motion, with second agreeing, was amended to strike the last sentence in each section of the ordinance, “Decorative standing seam metal may be used in secondary roof applications.” Motion, second, and amendment were withdrawn and this item was held and staff directed to clarify language.
9. COUNCIL ACTION TO ALLOCATE CITY’S NON-PUBLIC SERVICE PROJECT CDBG FUNDING DIRECTED HELD TO 9/4/07 COUNCIL MEETING, WITH DIRECTION TO STAFF TO INVESTIGATE GOODWILL INDUSTRIES SIDEWALK ISSUE.
Council action to allocate the City’s non-public service project CDBG funding was directed held to the September 4, 2007 Council meeting, with direction to staff to investigate the Goodwill Industries sidewalk issue.
10. DIRECTED HELD: COUNCIL UPDATE ON DEVELOPMENT OF MARKETING PLANS FOR CITY OF OAK CREEK.
The Council update on the development of marketing plans for the City of Oak Creek was directed held.
11. PRESENTED AND ADOPTED: COUNCIL PROCLAMATION NO. 07-09, APPRECIATION TO RONALD R. CALLIES FOR DEDICATED SERVICE AS MEMBER OF OAK CREEK WATER & SEWER UTILITY COMMISSION.
Ald. Grabowski, seconded by Ald. Michalski, moved to adopt Council Proclamation No. 07-09, appreciation to Ronald R. Callies for dedicated service to the City of Oak Creek and the Oak Creek Water & Sewer Utility as a member of the Oak Creek Water & Sewer Utility Commission. On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Verhalen, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, aye.
12. INFORMATIONAL ONLY: MAYORAL PROCLAMATION OF CONGRATULATIONS TO KEVAN P. THOMAS FOR RECEIVING EAGLE SCOUT AWARD.
The Mayoral Proclamation of congratulations to Kevan P. Thomas for receiving the Eagle Scout Award was informational only.

14. LICENSE COMMITTEE.

15. COUNCIL PROVIDED WITH CURRENT STATUS REGARDING IMPLEMENTATION OF INTERNAL CONTROL POLICY AND REAFFIRMS DIRECTIVE FROM MAYOR AND COMMON COUNCIL TO ENSURE THAT APPROPRIATE INTERNAL CONTROL RECOMMENDATIONS BE IMPLEMENTED AT WATER & SEWER UTILITY AFTER REILLY, PENNER & BENTON STUDY.
The Council was provided with the current status regarding implementation of the internal control policy by City Treasurer Barb Guckenberger. Ald. Kopplin, seconded by Ald. Michalski, moved to reaffirm the directive from the Mayor and Common Council to ensure that appropriate internal control recommendations be implemented at the Water & Sewer Utility after completion of the internal study by Reilly, Penner & Benton. 16. COUNCIL AUTHORIZES PURCHASE OF 52 SETS OF FIRE TURN-OUT GEAR FROM PAUL CONWAY SHIELDS, INC., IN AMOUNT OF $98,424.04.
Ald. Kopplin, seconded by Ald. Michalski, moved to authorize the purchase of 52 sets of fire turn-out gear from Paul Conway Shields, Inc., in the amount of $98,424.04. On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Verhalen, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, aye.
17. COUNCIL GRANTS FIRE DEPARTMENT APPROVAL TO APPLY FOR SAFER ACT GRANT.

18. DIRECTED HELD: COUNCIL AUTHORIZATION TO TRANSFER REMAINING BALANCE FROM SOUTHBRANCH INDUSTRIAL PARK ROAD RECONSTRUCTION PROJECT (PROJECT NO. 04003) TO W. DREXEL AVE. PROJECT (PROJECT NO. 06010).
Council authorization to transfer the remaining balance from the Southbranch Industrial Park road reconstruction project (Project No. 04003) to the W. Drexel Ave. project (Project No. 06010) was directed held.
19. MAYOR BREAKS TIE TO APPROVE PERMANENT INSTALLATION OF 3-WAY STOP SIGNS AT INTERSECTION OF S. 3RD ST. AND S. DONALD DR.
Ald. Toman, seconded by Ald. Verhalen, moved to concur with the recommendation of the Traffic and Safety Commission and approve the permanent installation of 3-way stop signs at the Intersection of S. 3rd St. and S. Donald Dr. On roll call, the vote was as follows: Ald. Kopplin, no; Ald. Foeckler, no; Ald. Verhalen, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, no. The vote resulted in a tie. The Mayor voted aye; motion carried.
20. COUNCIL AUTHORIZES PAYMENT OF CONTRACT PAYMENTS FOR PROJECT NO. 06027, STREET DEPARTMENT BUILDING DESIGN AND RENOVATION.
Ald. Foeckler, seconded by Ald. Grabowski, moved to authorize payment of the contract payments for Project No. 06027, Street Department Building Design and Renovation. On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Verhalen, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, aye.
21. PRESENTED AND ADOPTED: ORDINANCE NO. 2471, CHANGING POLLING PLACE LOCATIONS FOR CITY OF OAK CREEK.

Kopplin, moved to adopt Ordinance No. 2471, repealing and recreating Section 2.05 of the Municipal Code to change the polling place locations for the City of Oak Creek. On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Verhalen, aye; Ald. Toman, aye; Ald. Grabowski, aye; and Ald. Michalski, aye.

26. COUNCIL APPROVES PREPARATION AND MAILING OF INFORMATIONAL FLYER TO ALL OAK CREEK RESIDENCES REGARDING OCTOBER 9, 2007 SPECIAL REFERENDA ELECTION (ELECTED VS. APPOINTED CLERK AND TREASURER POSITIONS), AND TO SCHEDULE AND ADVERTISE PUBLIC INFORMATION MEETING FOR MONDAY, SEPTEMBER 24, 2007 AT 7:00 P.M.

Kopplin, moved to approve the preparation and mailing of an informational flyer to all Oak Creek residences regarding the October 9, 2007 Special Referenda Election (elected vs. appointed Clerk and Treasurer positions), and to schedule and advertise a public information meeting for Monday, September 24, 2007 at 7:00 p.m. On roll call, the vote was as follows: Ald.
