Minutes, License Committee

Thursday, July 12, 2007 at 8:00 A.M.

  1. This meeting was called to order at 8:02 a.m.  Present were:  Ald. Foeckler, Ald. Verhalen, Ald. Grabowski, and Deputy Clerk Pam Bauer.
  2. Mr. Kenneth S. Wilkowski, Jr., was present regarding his application to solicit sales for D & E Cable, LLC (a subcontractor for Time Warner Cable).  This item was held to obtain police reports and to further discuss the application and incidents with Mr. Wilkowski.  The committee had previously been provided with a copy of the incident report from the Ozaukee County Sheriff’s Department relating to the “road rage” incident on 7/20/06.  Mr. Wilkowski again restated the incident for which he was cited for disorderly conduct.  He also restated the odometer rollback incident where he was attempting to sell a vehicle and after an unsuccessful attempt, rolled back the odometer 11 or 12,000 miles.  He was caught, convicted and paid fines.  After going through the proper process, he was ultimately able to sell the vehicle.  The Police Department was unable to obtain a police report on this incident.  He stated he was somewhat confused with the application form, and at the time of application circled “misdemeanor” and checked off “no” relating to any conviction record.  He showed the committee current licenses he has with other communities, and requested a license be granted to allow him to continue to work.  Ald. Grabowski, seconded by Ald. Foeckler, moved to grant a transient merchant license to Kenneth S. Wilkowski, Jr., soliciting sales for D & E Cable.  All voted aye; motion carried.
  3. Louis Malinski, 58 years of age, was present regarding his application to solicit sales of frozen ice cream products for Klondike Distributors.  Mr. Malinski failed to list any convictions on his application.  He stated his supervisor filled out the form for him, but he did not review it thoroughly before signing it.  He did state that he told his supervisor to list his convictions, but she failed to do so.  He verified that he spent time at the Green Bay Correctional Institute in 1969 for attempting to operate a vehicle without owner’s consent (a non-felony conviction).  He explained that after he was released from prison and while on work release cooking for McDonald’s, he failed to report to work because he overslept.  The marshals found him at his mother’s house and he was charged with an escape violation. He also had an incident where he was driving a taxicab after his release, and had been robbed several times.  He purchased a gun for protection while driving his taxi, but never used it.  Due to his 1969 conviction, he was to wait 7 years to purchase a gun, but was three months short of the seven years.  When his firearms paperwork went to Chicago for processing, he was arrested.  His last conviction was in September 1999 for operating without a CDL. 
  4. He stated that he currently holds a transient merchant license in the communities of Waukesha, New Berlin and Dousman.  Ald. Foeckler, seconded by Ald. Grabowski, moved to approve a license for Mr. Malinski, subject to confirmation with the three communities that he does hold a license and that there have been no negative reports or complaints.  All voted aye; motion carried.  Note:  Following are the results of contact with the communities listed above on 7/12/07:  New Berlin – approved in May 2007; no complaints; Waukesha – approved on 5/9/07; no complaints; and Dousman – approved in spring of 2007; no complaints and third year licensed.

  5. Ald. Grabowski, seconded by Ald. Foeckler, moved to grant a Special Class B Beer and Wine license to the Oak Creek OJ’s for 8/4-5/07 (rain dates (8/11-12/07) at Shepard Hills School and Oak Creek High School ball diamonds and to grant their request for a waiver of fees.  All voted aye; motion carried.

  8. Pam explained that the Ay Caramba restaurant, 924 E. Rawson Ave. has closed and the licensee did not renew his license.  The business remains closed.  The owner of the property, Bessie Lintzeris, was notified and submitted an Original application.  An occupancy permit and restaurant license would be required prior to opening for business.  Ald. Foeckler, seconded by Ald. Grabowski, moved to grant an original Class B Combination license to Bessie Lintzeris, 7529 S. Crane Dr., for the business at 924 E. Rawson Ave.  All voted aye; motion carried.

Ald. Grabowski, seconded by Ald. Foeckler, moved to adjourn this meeting at 8:30 a.m.  All voted aye; motion carried.
