A public hearing was held to consider a proposal by The Gathering Partners (Kathy Howlett-Despot) to rezone the properties at 8825 S. Howell Ave. and 155 W. Howell Ave., as amended to include the display and sale of trailers and the rental of moving trucks and towable camper trailers (in the title of the ordinance, in the 2nd whereas clause and in Section 1 of the ordinance); to amend the conditions and restrictions, Section 8(d) to state that outdoor display of towable camper trailers for sale or rent and rental trucks shall be limited to a paved section within the existing fenced-in area; and to amend Section 8(e) to state that there shall be no more than 5 moving trucks, moving vans or moving trailers stored outside on a paved section within the existing fenced-in area. 12. CITY’S CONCERNS ABOUT RECENT LEGISLATIVE ACTIONS REGARDING IMPACT FEES TO BE EXPRESSED TO STATE LEGISLATORS REPRESENTING CITY OF OAK CREEK; COUNCIL AUTHORIZES CITY ADMINISTRATOR AND CITY CLERK TO PROVIDE PROMPT COMMUNICATION TO LEGISLATORS ON BEHALF OF CITY WHEN PENDING LEGISLATION COULD BE DETRIMENTAL TO CITY. SENATOR JEFF PLALE AND REPRESENTATIVE MARK HONADEL TO BE INVITED TO ATTEND FUTURE COUNCIL MEETING.

Grabowski, moved to express the City’s concerns to the state legislators representing the City of Oak Creek about recent legislative actions regarding impact fees; and authorize the City Administrator and City Clerk to provide prompt communication to legislators on behalf of the City when pending legislation could be detrimental to the City. Motion, with second agreeing, was amended to include an invitation to Senator Jeff Plale and Representative Mark Honadel to attend a future Council meeting (subsequently scheduled for 8/15/06). Foeckler, moved to authorize the Mayor and City Clerk to enter into a cell phone contract with Sprint Nextel, Inc., to provide cellular phones and service for City staff and terminate the cell phone contract with US Cellular. 19. DIRECTED HELD: COUNCIL ACTION TO AUTHORIZE MAYOR AND CITY CLERK TO ENTER INTO LEASE AGREEMENT WITH UNITED STATES CELLULAR OPERATING COMPANY LLC, DBA US CELLULAR, FOR CONSTRUCTION OF 150-FOOT CELL TOWER AT 301 W. RYAN RD. (POLICE STATION), AND PLACEMENT OF COMMUNICATION ANTENNAS ON SAID MONOPOLE.
Council action to authorize the Mayor and City Clerk to enter into a lease agreement with United States Cellular Operating Company LLC, doing business as US Cellular, for the construction of a 150-foot cell tower at 301 W. Ryan Rd. (police station), and the placement of communication antennas on said monopole was directed held.

PRESENTED AND ADOPTED: ORDINANCE NO. 2413, REPEALING ORDINANCE NO. 387, PROHIBITING PARKING ON EITHER SIDE OF CERTAIN STREETS IN NORTHBRANCH INDUSTRIAL PARK (ADOPTED 9/2/69); COUNCIL AUTHORIZES INSTALLATION OF “NO PARKING” SIGNS FROM 7616 TO 7815 S. 6TH ST., EXCEPT DURING LITTLE LEAGUE EVENTS; AUTHORIZES INSTALLATION OF “NO PARKING” SIGNS ELSEWHERE IN NORTHBRANCH INDUSTRIAL PARK, AND DIRECTS CITY ADMINISTRATOR AND CITY ATTORNEY TO INVESTIGATE LEASE WITH LITTLE LEAGUE AND POSSIBILITY OF REQUIRING LITTLE LEAGUE TO PAVE THEIR PARKING LOT.

Michalski, moved to adopt Ordinance No. 2413, repealing Ordinance No. 387, an ordinance prohibiting parking on either side of certain streets in the Northbranch Industrial Park (adopted 9/2/69), and authorizing the installation of no parking signs through the Northbranch Industrial Park, except from 7616 to7815 S. 6th St. On roll call, the vote was as follows: Ald. Kopplin, no; Ald. Foeckler, no; Ald. Lampe, no; Ald. Toman, aye; Ald. Grabowski, no; and Ald. Michalski, aye. Motion failed.

Ald. Foeckler, seconded by Ald. Grabowski, moved to authorize a settlement with Gonis Real Estate Ltd. Partnership for parcels at 27th St. and Rawson Ave., for an aggregate assessed value to be set at $2 million for the 2004 through 2006 assessment years (as it relates to the lawsuits pending in Milwaukee County Circuit Court relating to claims for excessive assessments for the 2004 assessment).
