PROCEEDINGS, COMBINED COMMON COUNCIL MEETING

The meeting began with the Pledge of Allegiance being said by all present.

Mayor Bolender called the meeting to order at 7:00 p.m.  On roll call, the following aldermen were present:  Ald. Kopplin, Ald. Foeckler, Ald. Lampe, Ald. Toman, Ald. Grabowski, and Ald. Jonas.  Also present were:  City Attorney Lawrence Haskin, Director of Community Development Douglas Seymour, City Engineer Wayne St. John, Fire Chief Gerard Hammernik, Police Chief Thomas Bauer, Police Captain William Wilson, Director of Parks, Recreation and Forestry Douglas Schachtner, and City Clerk Beverly Buretta.

1.         PUBLIC HEARING HELD TO CONSIDER PROPOSAL BY SIKH TEMPLE OF WISCONSIN TO REZONE PROPERTIES AT 7502 AND 7512 S. HOWELL AVE. FROM RS-3 SINGLE FAMILY RESIDENTIAL TO I-1 INSTITUTIONAL. 

            A public hearing was held to consider a proposal by the Sikh Temple of Wisconsin to rezone the properties at 7502 and 7512 S. Howell Ave. from Rs-3 Single Family Residential to I-1 Institutional.  A summary transcript is available in the City Clerk’s Office (see item 4 for action on this hearing).

2.         PUBLIC HEARING HELD TO CONSIDER PROPOSAL BY TED O’LESKE (EARLY CHILDHOOD EDUCATION CENTER) TO REZONE PROPERTY AT 10479 S. CHICAGO RD. FROM B-2 COMMUNITY BUSINESS TO B-3 OFFICE AND PROFESSIONAL BUSINESS, WITH CONDITIONAL USE PERMIT FOR DAY CARE CENTER WITH OUTDOOR ACTIVITY AREA. 

            A public hearing was held to consider a proposal by Ted O’Leske (Early Childhood Education Center) to rezone the property at 10479 S. Chicago Rd. from B-2 Community Business to B-3 Office and Professional Business, with a conditional use permit for a day care center with an outdoor activity area.  A summary transcript is available in the City Clerk’s Office (see item 5 for action on this hearing).

3.         PUBLIC HEARING HELD CONSIDER PROPOSAL BY PRANKE HOLDINGS, LLC TO REZONE PROPERTY AT 8750 S. HOWELL AVE. FROM B-3 OFFICE AND PROFESSIONAL BUSINESS TO B-2 COMMUNITY BUSINESS. 

            A public hearing was held to consider a proposal by Pranke Holdings, LLC to rezone the property at 8750 S. Howell Ave. from B-3 Office and Professional Business to B-2 Community Business.  A summary transcript is available in the City Clerk’s Office (see item 6 for action on this hearing).

4.         PRESENTED AND ADOPTED WITH CONDITION:  ORDINANCE NO. 2354, APPROVING REZONING OF PROPERTIES AT 7502 AND 7512 S. HOWELL AVE. FROM RS-3 SINGLE FAMILY RESIDENTIAL TO I-1 INSTITUTIONAL (SIKH TEMPLE OF WISCONSIN).

            Ald. Kopplin, seconded by Ald. Foeckler, moved to adopt Ordinance No. 2354, approving the rezoning of the properties at 7502 and 7512 S. Howell Ave. from Rs-3 Single Family Residential to I-1 Institutional (Sikh Temple of Wisconsin), with the understanding that as part of the approval of the development agreement, there be an easement drafted for the eastern 1/4 of the property that would restrict the uses to open space; and the subject of that easement would be approved by the Council in a future action.  On roll call, the vote was as follows: Ald. Ald. Grabowski, seconded by Ald. Lampe, moved to adopt Ordinance No. 2356, approving the rezoning of the property at 10479 S. Grabowski, moved to adopt Council Proclamation No. 05-11, to Rudolph Sutschek for dedicated service to the City of Oak Creek as a member of the Board of Review.  On roll call, the vote was as follows: Ald. 10.       COUNCIL CONCURS WITH REALIGNMENT OF BOARD OF REVIEW MEMBERS AS RESULT OF RESIGNATION OF MR. SUTSCHEK.

Ald. Kopplin, seconded by Ald. Grabowski, moved to concur with the realignment of Board of Review members as follows, as a result of the resignation of Mr. Sutschek: 

            a.         Thomas Lewison would become a regular member to complete Mr. Sutschek’s term expiring 5/09;

            b.         Dennis McNulty would become Alternate No. 1 to complete a term expiring 5/10; and

            c.         One vacancy is created as Alternate No. 2, for a term expiring 5/10.

Ald. Jonas, seconded by Ald. Grabowski, moved to adopt Ordinance No. 2357, relating to the establishment of the Street Department and the position of Street Superintendent. 12.       LICENSE COMMITTEE.

            Ald. Toman called for a division of the question to take the Butcher Block application separately.  Ald. Grabowski, seconded by Ald. Jonas, moved to take the recommended action on each license request as listed, with the exception of the “Class A” Combination license application submitted for the Butcher Block.  On roll call, the vote was as follows: Ald. 13.       COUNCIL APPROVES BID OF $90,000.00 FROM AMERICAN RAMP COMPANY FOR PURCHASE AND INSTALLATION OF SKATE PARK EQUIPMENT FOR OAK PARK/EAST MIDDLE SCHOOL SITE. 

Ald. Lampe, seconded by Ald. Grabowski, moved to concur with the recommendation of the Director of Parks, Recreation and Forestry and approve the bid of $90,000.00 from American Ramp Company for the purchase and installation of skate park equipment for the Oak Park/East Middle School site.  On roll call, the vote was as follows: Ald. 14.       COUNCIL AUTHORIZES USE OF SUPERVISORY ASSISTANCE FOR HEALTH DEPARTMENT ON TEMPORARY BASIS THROUGH MILWAUKEE/WAUKESHA COUNTY CONSORTIUM MUTUAL AID AGREEMENT, ONLY IN EVENT OF PUBLIC HEALTH EMERGENCY, DURING ABSENCE OF BOTH HEALTH OFFICER AND PHN SUPERVISOR.

Toman, moved to authorize the use of supervisory assistance for the Health Department on a temporary basis through Milwaukee/Waukesha County Consortium Mutual Aid Agreement, only in the event of a public health emergency, during an absence of both the Health Officer and PHN Supervisor.  On roll call, the vote was as follows: Ald. 24.       COUNCIL APPROVES CREATION OF “STORM SEWER IN ST. JOHN’S ESTATES SUBDIVISION” PROJECT AND TRANSFER OF $115,000 FROM NON-SPECIFIED STORM WATER TO FUND ITS CONSTRUCTION, DIRECTS THAT FUNDS RECOVERED FROM DEVELOPER REIMBURSE NON-SPECIFIED STORM WATER ACCOUNT. 

Ald. Jonas, seconded by Ald. Grabowski, moved to create the project “Storm Sewer in St. John’s Estates Subdivision” and transfer $115,000 from non-specified storm water to fund its construction, and to further direct that funds recovered from the developer reimburse the non-specified storm water account.  On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; Ald. Grabowski, aye Ald. Jonas, aye.

25.       COUNCIL DENIES REMOVAL OF STOP SIGNS AT INTERSECTION OF S. QUINCY AVE. AND E. MONROE AVE.

Ald. Kopplin, seconded by Ald. Foeckler, moved not to concur with the recommendation of the Traffic & Safety Commission to remove the stop signs at the intersection of S. Quincy Ave. and E. Monroe Ave.  The motion was restated by Ald. Kopplin, seconded by Ald.  Foeckler, to deny the removal and to let the signs remain at the intersection of S. Quincy Ave. and E. Monroe Ave.  On roll call, the vote was as follows: Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, no; Ald. Toman, aye; Ald. Grabowski, no; and Ald. Jonas, aye.

26.       COUNCIL APPROVES INSTALLATION OF “NO PARKING” SIGNS 50 FEET NORTH AND SOUTH OF PICK N’SAVE ENTRANCE ALONG BOTH SIDES OF S. MAYHEW DR.

Kopplin, moved to concur with the recommendation of the Traffic & Safety Commission and approve the installation of “No Parking” signs 50 feet north and south of the Pick n’Save entrance along both sides of S.
