MINUTES OF THE
TUESDAY, FEBRUARY 8, 2005
Mayor Bolender called the meeting to order at 7:00 p.m. The following Commissioners were present at roll call: Commissioner Dickmann, Commissioner Jackson, Commissioner Rolling, Commissioner Siira, Mayor Bolender, Commissioner Correll and Commissioner Peterson. Commissioner’s Kopplin and Foeckler were excused. Also present were Jeff Fortin, Planner and Assistant Fire Chief George Krudop.
Commissioner Siira moved to approve the minutes of the January 25, 2005, Plan Commission meeting. Commissioner Dickmann seconds. Commissioner Peterson requested that the roll call approval of the minutes from the January 11, 2005 be changed to reflect that Commissioners Peterson and Correll should have abstained from the vote because they were not in attendance at the January 11, 2005 meeting. First and second concur. Roll call, all voted aye. Motion carries.
Report on Significant Common Council Actions
Mr. Jeff Fortin, Planner updated the Commissioners on the actions that were taken at the February 1, 2005, Common Council meeting.
No comments or concerns from the Commission.
Certified Survey Map – Robert Fait (Trattoria diCarlo)
8649 and part of 8743 S. Howell Avenue
Tax Key Nos.: 828-9002, part of 828-9996-001
Mr. Jeff Fortin, Planner explained to the Commission that the applicant was requesting approval of a certified survey map joining the property at 8649 S. Howell Avenue with Parcel 2 of CSM #7476 which was recently divided from the property at 8743 S. Howell Avenue. The newly created parcel will be 3.9 acres.
Commissioner Dickmann moved that the Plan Commission recommend that the Common Council approve the certified survey map subject to any technical corrections being made prior to recording.
Commissioner Rolling seconds. Roll call, all voted aye. Motion carries.
Plan Review – James Roszina
10510 S. 13th Street

Mr. Jeff Fortin, Planner explained to the Commission that the applicant was requesting Plan Commission approval to replace one of three (3) existing accessory buildings on the property at 10510 S. 13th Street. The applicant had these accessory buildings on his property since before the Zoning Ordinance changed allowing only two accessory buildings on parcels of one acre or less in size. The existing brick building is planned to be razed and replaced with the proposed building.
Commissioner Siira questioned the size of the building that was being replaced. Mr. Jeff Fortin, Planner explained it was slightly larger than 1000 square feet.
Commissioner Correll questioned the height of the existing walls. Mr. James Roszina, 10510 S. 13th Street stated the existing building had 10 feet high walls.
Commissioner Siira questioned if Mr. Roszina understood the conflict with the size and height of the building and questioned if he intended to go to the Zoning Board of Appeals. Mr. Roszina explained that he needed the structure.
Mayor Bolender explained that the size was above and beyond what the current ordinance would allow and that created a conflict for approval. Mr. Roszina realized the problem and was planning on applying for a variance.
Mr. Jeff Fortin, Planner explained that if the Commission did not choose to approve the height and area of the building they could approve the concept of having a third accessory building within the height and size limits of the ordinance.
Commissioner Siira questioned which building was being replaced. Mr. Roszina replied the long narrow building would be replaced and the new building would go in the same spot.
Mr. John Drew, 1131 W. Finch Lane, questioned what the building would be used for because Mr. Roszina was running an agriculture business out of a residentially zoned property. Mr. Roszina stated the building would be used for storage of a motor home.
Mr. Drew expressed concern about the farm equipment and the wood piles on Mr. Roszina’s property.
Commissioner Correll moved that the Plan Commission approve the application for the replacement third accessory building at 10510 S. 13th Street with the new building not to exceed current ordinance limitations, specifically 1000 square feet with a maximum height of 12 feet.
Commissioner Peterson seconds. Roll call, all voted aye. Motion carries.
Preliminary Plat – Orchard View Subdivision
10222 S. Shepard Avenue

Mr. Jeff Fortin, Planner explained to the Commission that the applicant was requesting preliminary plat approval for the Orchard View subdivision located at 10222 S. Shepard Avenue. The preliminary plat creates five lots and two outlots for stormwater management. The lots in this subdivision meet or exceed the size requirements for the zoning.
Mayor Bolender commented on the size change of the lots and hoped in the future the City could attract larger lot and home sizes.
Mr. Raffia Sharikia, Micjensar Development, stated the homes would be in the range of mid $300,000 and there would be several builders in this location.
Commissioner Siira questioned the reasoning behind the size of lot 5. It appears that another lot could have been added. Mr. Sharikia explained lot 5 was that size because an additional lot would make the lots elongated and the homes would be too close together.
Commissioner Siira also questioned the problem with the angle of the lot lines. Mr. Jeff Fortin, Planner explained the code reads that the lot lines need to be perpendicular to the curve. At present the lot lines are intersecting at an angle.
Commissioner Siira questioned the future public street pattern on the official map. Mr. Jeff Fortin, Planner stated the street would probably not go in. Commissioner Jackson explained the area of land to the north of lot 5 would potentially be acquired by the City because it was in the floodplain. The street is all in the floodplain so it could not be developed.
Commissioner Peterson moved that the Plan Commission approve the preliminary plat for the Orchard View Subdivision subject to the following conditions:
1. That a development agreement be entered into between the owner and the City to specify the responsibility for and the timing of public improvements.
2. That grading, drainage and stormwater management plans are approved by the City Engineer.
3. That the applicant change the name of the subdivision prior to creation of the development agreement.
4. That the applicant creates a landscaped cul-de-sac island and designates it as an outlot to be owned and maintained by the homeowner’s association prior to creation of the development agreement.
5. That any technical corrections are made prior to final plat submittal.

Preliminary Plat – Shepard’s Orchard Subdivision
10020, 10050, 10110, and 10160 S. Shepard Avenue

Mr. Jeff Fortin, Planner explained to the Commission that the applicant was requesting preliminary plat approval for the Shepard’s Orchard subdivision. The preliminary plat creates forty-six lots and four outlots in the Rs-2, Single Family Residential zoning district. The lots in this subdivision meet or exceed the requirements for the zoning requirements.
Commissioner Peterson questioned whose responsibility it would be to remove the temporary cul-de-sacs. Commissioner Jackson explained the developer to the north would be responsible to remove the cul-de-sacs and bring the restoration up to a normal lot.
Commissioner Siira questioned the location of lots 2 and 27. Mr. Jeff Fortin, Planner explained that the lots were currently designated as outlots 3 and 4 at this time and will be future lots 2 and 27.
Mrs. Betty Lewkowski, 9950 S. Shepard Avenue, expressed concern for the future street locations. She did not like the way it went onto other people’s property. She would not be able to develop her property without the consent of those property owners. Mr. Jeff Fortin, Planner explained that the official map was not being discussed at this time and the Micjensar Development was working within the officially mapped streets.
Commissioner Rolling questioned the corner lot on Oak Street. It was her understanding that there was not supposed to be a corner lot at that location. Mr. Jeff Fortin, Planner, explained the details for that lot was worked out with attorneys and all parties are in agreement with the layout of the subdivision.
Ms. Dorothy Hanson, 511 E. Shepard Avenue, stated for future reference she did not want a street on her property and would not allow development on her property.
Commissioner Correll moved that the Commission approve the preliminary plat for Shepard’s Orchard Subdivision subject to the following conditions:
