PROCEEDINGS, COMBINED COMMON COUNCIL MEETING

TUESDAY, OCTOBER 4, 2005, 7:00 P.M.

The meeting began with the Pledge of Allegiance being said by all present.

Mayor Bolender called the meeting to order at 7:00 p.m.  On roll call, the following aldermen were present:  Ald. Kopplin, Ald. Foeckler, Ald. Lampe, Ald. Toman, and Ald. Jonas.  Ald. Grabowski was excused.  Also present were:  City Attorney Lawrence Haskin, Director of Community Development Douglas Seymour, City Engineer Wayne St. John, Assistant Fire Chief Thomas Rosandich, Street Superintendent William Schaper, and Deputy Clerk Pam Bauer.

Ald. Jonas, seconded by Ald. Kopplin, moved to approve the minutes of the 8/30/05, 9/6/05, 9/20/05 and 9/28/05 meetings as published. On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

1.         PUBLIC HEARING HELD TO CONSIDER PROPOSAL BY CITY TO AMEND SECTIONS 17.0305, 17.0306, 17.0307, 17.0308 AND 17.0310 OF MUNICIPAL CODE REGARDING SIDE YARD SETBACKS FOR RESIDENTIAL BUILDINGS WITH SIDE ENTRY GARAGES.  

            A public hearing was held to consider a proposal by the City of Oak Creek to amend Sections 17.0305, 17.0306, 17.0307, 17.0308 and 17.0310 of the Municipal Code regarding the side yard setbacks for residential buildings with side entry garages.  A summary transcript is available in the City Clerk’s Office (see item 2 for action on this hearing).

2.         PRESENTED AND ADOPTED:  ORDINANCE NO. 2375, AMENDING SECTIONS 17.0305, 17.0306, 17.0307, 17.0308, AND 17.0310 OF MUNICIPAL CODE REGARDING SIDE YARD SETBACKS FOR RESIDENTIAL BUILDINGS WITH SIDE ENTRY GARAGES. 

            Ald. Jonas, seconded by Ald. Toman, moved to adopt Ordinance No. 2375, amending Sections 17.0305, 17.0306, 17.0307, 17.0308, and 17.0310 of the Municipal Code regarding the side yard setbacks for residential buildings with side entry garages.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

3.         DIRECTED HELD:  ORDINANCE NO. 2371, REPEALING AND RECREATING SECTION 10.65(B)(1) AND SECTION 10.65 (E) OF MUNICIPAL CODE REGARDING JUNKED MOTOR VEHICLES.

            Ordinance No. 2371, an ordinance to repeal and recreate Section 10.65(b)(1) and Section 10.65 (e) of the Municipal Code regarding junked motor vehicles was directed held.

4.         VENDOR SUMMARY REPORT APPROVED.

            Ald. Foeckler, seconded by Ald. Jonas, moved to approve the Vendor Summary Report in the amount of $362,558.89.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

5.         PRESENTED AND ADOPTED SUBJECT TO LEGAL REVIEW AND APPROVAL BY CITY’S LABOR COUNSEL:  RESOLUTION NO. 10551-100405, AUTHORIZING PARTICIPATION OF CITY IN PUBLIC WORKS EMERGENCY RESPONSE MUTUAL AID AGREEMENT.

            Ald. Jonas, seconded by Ald. Foeckler, moved to adopt Resolution No. 10551-100405, authorizing the participation of the City of Oak Creek in a public works emergency response mutual aid agreement, subject to legal review and approval by the City’s labor counsel, Davis & Kuelthau.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

6.         LICENSE COMMITTEE.

            Ald. Jonas, seconded by Ald. Foeckler, moved to grant an Operator’s license to:

            Jeannie Marie Stehling, 705 Sherman Ave., South Milwaukee (Bender Park Pub)

            Angelo Greco, 3465 S. 15th St., Milwaukee (Greco’s)

            William Joseph Stehling, 705 Sherman Ave., South Milwaukee (Bender Park Pub)

            Ann Marie Greco, 11532 Janet Ct., Franklin (Greco’s)

            Pamela Sue Baker, 2538 S. Logan Ave., Milwaukee (Applebee’s)

            On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

7.         PRESENTED AND ADOPTED:  RESOLUTION NO. 10550-100405, APPROVING STORM WATER MANAGEMENT PRACTICES MAINTENANCE AGREEMENT WITH THE DILLON GROUP, LLC, FOR THEIR PROPOSED BELMONT GROVE SUBDIVISION AT 8455 S. PENNSYLVANIA AVE.

            Ald. Lampe, seconded by Ald. Foeckler, moved to adopt Resolution No. 10550-100405, approving a storm water management practices maintenance agreement with The Dillon Group, LLC, for their proposed Belmont Grove subdivision at 8455 S. Pennsylvania Ave. On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

8.         COUNCIL AUTHORIZES INSTALLATION OF “NO PARKING SCHOOL DAYS” SIGNS ALONG NORTH SIDE OF E. BLUESTEM DR. ADJACENT TO DEERFIELD SCHOOL PROPERTY, AND “NO PARKING ANYTIME” ALONG SOUTH SIDE OF E. BLUESTEM DR. 30 FEET ON EITHER SIDE OF ENTRANCE TO DEERFIELD SCHOOL. 

            Ald. Jonas, seconded by Ald. Kopplin, moved to concur with the recommendation of the Traffic & Safety Commission and authorize the installation of “No Parking School Days” signs along the north side of E. Bluestem Dr. adjacent to the Deerfield School property, and “No Parking Anytime” along the south side of E. Bluestem Dr. 30 feet on either side of the entrance to Deerfield School.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

9.         DIRECTED HELD:  RESOLUTION NO. 10553-100405, APPROVING DEVELOPMENT AGREEMENT FOR MALLARD CREEK SUBDIVISION, 10026 AND 10140 S. NICHOLSON RD. AND 1834 E. OAKWOOD RD.

            Resolution No. 10553-100405, approving the development agreement for the Mallard Creek subdivision, 10026 and 10140 S. Nicholson Rd. and 1834 E. Oakwood Rd. was directed held.

10.       PRESENTED AND ADOPTED:  RESOLUTION NO. 10552-100405, APPROVING CSM FOR PARKWAY APOSTOLIC CHURCH PROPERTY AT 10820 S. NICHOLSON RD. 

            Ald. Foeckler, seconded by Ald. Jonas, moved to adopt Resolution No. 10552-100405, approving a certified survey map for the Parkway Apostolic Church property at 10820 S. Nicholson Rd.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

11.       PRESENTED AND ADOPTED, WITH RECORDING OF MAP TO BE HELD UNTIL SEWER AND WATER ARE IN PLACE:  RESOLUTION NO. 10548-100405, APPROVING CSM FOR PROPERTY AT 8201 S. HOWELL AVE. (DEMCO WISCONSIN 1, LLC). 

            Ald. Foeckler, seconded by Ald. Jonas, moved to adopt Resolution No. 10548-100405, approving a certified survey map for the property at 8201 S. Howell Ave. (DEMCO Wisconsin 1, LLC).  Motion, with second agreeing, was amended to hold recording of the map until sewer and water are in place.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Foeckler, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

            ADJOURNMENT.

            Ald. Lampe, seconded by Ald. Jonas, moved to adjourn this meeting at 7:52 p.m.  All voted aye; motion carried.
