PROCEEDINGS, SPECIAL COMMON COUNCIL MEETING

WEDNESDAY, AUGUST 4, 2004, 6:00 P.M.

CITY OF OAK CREEK

MILWAUKEE COUNTY

1.         Mayor Bolender called the meeting to order at 6:00 p.m.  On roll call, the following aldermen were present:  Ald. Kopplin, Ald. Lampe, Ald. Toman, and Ald. Jonas.  Ald. Foeckler and Ald. Grabowski were excused.  Also present were:  City Attorney Lawrence Haskin, Police Captain Warren Endthoff, Attorney Kathy Nusslock of Davis & Kuelthau, representing Captain Endthoff, Attorney Carl Ricciardi, representing Kathleen and Richard Rothen (also present), and Deputy City Clerk Pam Bauer.

2.         A hearing was held on whether WI Gifts, Inc., d/b/a Cupid’s Toys, 7070 S. 27^th St., constitutes an adult entertainment business.

3.         Ald. Jonas, seconded by Ald. Toman, moved to determine whether WI Gifts, Inc., d/b/a Cupid’s Toys, 7070 S. 27^th St., does constitute an adult entertainment business.  Motion, with second agreeing, was amended to make the determination, based upon the evidence presented, that WI Gifts, Inc., d/b/a Cupid’s Toys, 7070 S. 27^th St., does constitute an adult entertainment business.  On roll call, the vote was as follows:  Ald. Kopplin, aye; Ald. Lampe, aye; Ald. Toman, aye; and Ald. Jonas, aye.

            Ald. Lampe, seconded by Ald. Kopplin, moved to adjourn this meeting at 10:01 p.m.  All voted aye; motion carried.
