Minutes, Small Claims Committee

  1. This meeting was called to order at 8:15 a.m. on Friday, January 9, 2004, in the Mayor’s office at Oak Creek City Hall, 8640 S. Howell Ave.
  2. Roll Call: 

    Present were: Alderman Dimity Grabowski and City Clerk Beverly Buretta.  Mayor Dick Bolender was excused.

  3. Review of claims:

    a.         Claim of James Nickols, 3339 E. Woodview Ave., in the approximate amount of $662.86 to recode the doors on his vehicle as it relates to a police incident on 11/21/03.

    Mr. Nickols was present.  Also present was Lt. Artka, OCPD.

    Mr. Nickols explained his version of the situation that led to his claim.  He stated that he had given his keys to a police officer, yet the police were unable to find them to return them to him.  He was concerned that his vehicle could be stolen because the keys may have been taken by someone at the site of the incident, and he wanted to have the locks re-coded.  Lt. Artka explained the police version based on the written department reports and his own research.  He agreed that the keys could not be found and he could not verify that the keys had been brought to the police station although it is usual procedure to keep the keys and return them to the owner.   Ald. Grabowski felt that the City should authorize replacement of the keys and attachments to the key ring, but felt that recoding of the locks was a personal choice for Mr. Nickols to make.

    It was moved by D. Grabowski, seconded by B. Buretta, to deny Mr. Nickol’s  claim in the amount of $662.86 for recoding of door locks on his vehicle, and to authorize payment of $40.00 to replace Mr. Nickol’s keys and attachments that were lost on 11/21/03, contingent on his signing the appropriate release form.  

  4. Adjournment

    B. Buretta, seconded by D. Grabowski, moved to adjourn at 8:50 a.m.  All  voted aye.
