Recommendation:  That the Council adopt Ordinance No. 2493 amending Ordinance 2464 to extend to allow for outdoor storage in the side yard and to allow the use of crushed, recycled asphalt as a permitted surface material in the outdoor storage area for the Black Diamond Properties located at 6925 and 6965 S. 6th Street.

 

Background: On July 6, 2004 the Common Council adopted Ordinance 2313, approving the conditional use and corresponding conditions and restrictions for Black Diamond Paving for the properties at 6925, 6945 and 6965 S. 6th Street.  Since that time there have been two (2) time extensions granted for the commencement of construction.  Also since the initial approval the layout of the property has been changed due to wetlands and floodplain constraints.  The current proposed layout shows the outdoor equipment storage area to the north of the building in the side yard.  However this is not permitted under the conditions and restrictions.  Section 5G states that “Outdoor storage shall not be located within the front or side yard, and shall be screened from casual view by means of screening that is compatible with the main building/structure and landscaping.”

 

The applicant is therefore requesting an amendment to the conditional use permit that would allow for outdoor storage in the side yard.  There is a significant amount of trees and existing vegetation that would completely screen the outdoor storage area from S. 6th Street.  Staff also visited the site and believes that the equipment will not be visible from the right-of-way and therefore is supportive of the requested amendment.

 

Black Diamond is also requesting an additional amendment to the conditional use permit that would allow them to use crushed recycled asphalt to surface the outdoor storage area only (the rest of the drives and parking areas would be hard-surfaced with concrete or asphalt). Section 3D of the conditions and restrictions states that “All off-street parking and equipment storage areas shall be surfaced with an all-weather wearing surface of plant mix asphaltic concrete over crushed stone base subject to approval by the City Engineer.  A proposal to use other materials shall be submitted to the Plan Commission and the Engineering Department for approval.”  The Plan Commission reviewed this request and felt that the crushed recycled asphalt would be an acceptable material given the heavy machinery that would be placed on it and the fact that there would be little to no dust from this material.

 

The Plan Commission has reviewed both of the proposed amendments, and has recommended that they both be approved.  A copy of the revised conditions and restrictions with the amendments incorporated is included with this report.   

 

Fiscal Impact:  There is no fiscal impact associated with this change.
