RESOLUTION APPROVING A WAIVER FROM SECTION 2G OF THE
CONDITIONAL USE PERMIT FOR THE PROPERTIES AT 9000 AND 9100 S. NICHOLSON ROAD
WHICH REQUIRES THAT MUNICIPAL SEWER BE EXTENDED TO SERVE THIS PROPERTY

WHEREAS, the Common
Council held a public hearing and adopted Ordinance 2479 granting Green Man
Wood Services a conditional use permit to operate a landscaping contractor’s
shop with outdoor storage of materials and equipment and the outdoor storage of
a combined total of no more than 50 recreational vehicles, trailers, or boats
for the properties at 9000 and 9100 S. Nicholson Road; and
WHEREAS the conditions and
restrictions Section 2D states that the applicant shall be required to extend
municipal sewer and water to serve this development. The applicant
retains the right to request a waiver from this requirement to the City of Oak
Creek Common Council in favor of a holding tank or well; and
WHEREAS,
Dan Gustin and Peter Gustin Sr., on behalf of The Green Man Wood Services, have
requested that the properties at 9000 and
NOW, THEREFORE, BE IT
RESOLVED that this waiver request is hereby approved by the Common Council.
