Recommendation: That the Council adopt Resolution No. 10842-031808 approving a certified survey map for Woodman’s Food Market, Inc. for the property at 8131 S. Howell Avenue.

Background: Woodman’s is requesting approval of a certified survey map (CSM) that would fix an error on the existing CSM. In April of 2007 Woodman’s recorded a CSM that created three (3) lots and an outlot for stormwater management. However prior to the CSM being created Giuffre XX, the owner of an adjacent parcel had deeded a small strip of land over to Woodman’s (a detailed map of this strip of land is included with this report). This was recorded in December of 2006. Since the City doesn’t review land transfers by deed and we hadn’t received the updated map files we were unaware of the transfer until after the map was recorded.

The strip of land was transferred from the parcel to the north of Woodman’s properties and was added to the north end of what is now Lot 3 of CSM 7910 (copy included with this report). A copy of the proposed CSM with the deeded area highlighted is also included with this report. This certified survey map will not create any additional lots, it is only being done to correct the error in the original so we have the correct lot boundaries recorded.

The Plan Commission has reviewed the proposed CSM and has recommended its approval.

Fiscal Impact: Development of this retail outlot will have a positive fiscal impact for the City.
