Recommendation:  That the Common Council adopt Resolution No. 10821-020508, accepting a 25’ general utility and access easement for Project No. 06060, Colonial Woods Development (Tax Key No. 810-9014)  (2nd Aldermanic District).

 

Background:  The easement is necessary for the sanitary sewer line that was installed for the Colonial Woods development.  The new easement covers the sanitary sewer line that was bored through the woods adjacent to S. 20th Street for the development.

RESOLUTION ACCEPTING A 25’ GENERAL

UTILITY AND ACCESS EASEMENT

 

(TAX KEY NO. 810-9014)

 

(2ND ALDERMANIC DISTRICT)

 

            WHEREAS, the City of Oak Creek desires to maintain and reconstruct, if necessary, sanitary sewer facilities on Lot 4 Certified Survey Map No. 7769 (Tax Key No. 810-9014); and

 

            WHEREAS, to enable the City to maintain and reconstruct said facilities, it will be necessary that an easement be obtained from the affected property owner; and

 

            WHEREAS, the general utility and access easement has been prepared affecting the following property owner, to wit:

 

City of Oak Creek

8640 S. Howell Avenue                                          

Tax Key No. 810-9014

 

and such easement is attached hereto.

                                                                                                           

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached easement be approved and hereby accepted.

 

            BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute the attached easement agreement on behalf of the Common Council of the City of Oak Creek, and upon the execution, the City Attorney being is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
