Recommendation: That the Common Council adopt Resolution No. 10820-020508 authorizing the vacation of an existing general utility and access easement on Lot 4 of Certified Survey Map No. 7769 (Tax Key No. 810-9014) (2nd Aldermanic District).
Background: The existing 25 general utility and access easement that was recorded on CSM No. 7769 was created to cover the proposed sanitary sewer line that was bored through the woods in the Colonial Woods development. The original boring was not successful for the sanitary sewer. Therefore, a new line was required to be bored through the woods. A new easement will be recorded to properly cover the sanitary sewer.

RESOLUTION AUTHORIZING THE VACATION OF
A 25 GENERAL UTILITY AND ACCESS EASEMENT
ON LOT 4 OF CERTIFIED SURVEY MAP NO. 7769
(TAX KEY NO. 810-9014)
(2ND ALDERMANIC DISTRICT)
WHEREAS, a 25-foot general utility and access easement was granted to the City of Oak Creek, recorded on Lot 4 Certified Survey Map No. 7769 and located in the SE Ό of the NW Ό of Section 18, T5N, R22E, City of Oak Creek, Milwaukee County, Wisconsin, more fully described as follows:
Commencing at the North Ό corner of said Section 18; thence S 00°0146 E, along the east line of the NW Ό of said Section, 2,197.49 feet; thence S 89°5814 W, 33.00 feet to the westerly right-of-way of S. 20th Street and the point of beginning of the hereinafter described lands; thence S 00°0146 E, along said westerly right-of-way, 25.42 feet; thence S 79°3538 W, 633.37 feet; thence N 13°3249 E, 9.02 feet; thence N 61°2603W, 26.64 feet; thence N 79°3538 E, 654.99 feet to the point of beginning. Said lands contain 15,358 square feet (0.35 acres).
NOW, THEREFORE BE IT RESOLVED by the Mayor and the Common Council of the City of Oak Creek that said general utility and access easement is hereby vacated, and
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to cause a certified copy of this resolution to be recorded in the office of the Register of Deeds in and for Milwaukee County, Wisconsin.
