Recommendation: That the Common Council adopt Resolution No. 10823-021808, a resolution accepting the installation of private sanitary sewer and private water main at the Southfield Apartments from Southfield Expansion, LLC, and releasing them from the terms and conditions of their development agreement (Project No. 05064) (Tax Key No. 736-8010) (1st Aldermanic District).
BACKGROUND: The Developer has completed, to the satisfaction of the Engineering and Street Departments and the Oak Creek Water and Sewer Utility, the required private sanitary sewer and private water main improvements for the Southfield Apartments at 6871 S. 13th Street. The Developer, Southfield Expansion, LLC, has installed the private sanitary sewer and private water main improvements free and clear of all impediments and encumbrances. There are no current outstanding assessments against the properties, and the Developer has paid all required City fees and costs.
FISCAL IMPACT: Oak Creek Water and Sewer Utility receives revenues based on the private sanitary sewer and private water main expansions.

RESOLUTION NO. 10823-021808
(PROJECT NO. 05064)
(1st ALDERMANIC DISTRICT)
WHEREAS, Southfield Expansion, LLC, hereinafter referred to as the "Developer," has constructed and installed all required private sanitary sewer and private water main improvements for said Southfield Apartments, at the expense of the Developer and in accordance with the plans and specifications conforming to applicable Milwaukee Metropolitan Sewerage District (MMSD), City Ordinances and approved by the City; and
WHEREAS, the Development Agreement provided that the developer shall install said private improvements to MMSD and City standards, and
WHEREAS, the Developer has complied with said MMSD and City standards.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the said private sanitary sewer and private water main installation be and the same hereby is accepted and
BE IT FURTHER RESOLVED, by the Common Council of the City of Oak Creek that the Developer is hereby released from the terms and conditions of their development agreement.
