Recommendation:  That the Common Council adopt Resolution No. 10815-011508, which would approve the Certified Survey Map (CSM) development agreement with Superior Die Set Corporation for the design and installation of public sanitary sewer at 900 W. Drexel Avenue (Project No. 07062) (Tax Key No. 783-9054) (1^st Aldermanic District).

Background:  Superior Die Set Corporation is proposing a two-lot CSM at 900 W. Drexel Avenue.  Before the City will release the CSM for Common Council approval and recording, the Developer must complete the design and installation of public sanitary sewer along the S. 10^th Street frontage of the proposed CSM.  Upon acceptance of the work by the Oak Creek Water and Sewer Utility and certification of the work by the City Engineer, the CSM will be presented to the Common Council for approval and recording. This agreement will provide the City with the authority to direct and control the design and construction of the required public sanitary sewer to ensure they meet City codes and specifications.

Fiscal Impact:  None.  Developer pays for all improvement costs.

RESOLUTION APPROVING THE

SUPERIOR DIE SET CSM AGREEMENT

(1^ST ALDERMANIC DISTRICT)

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Superior Die Set Corporation, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
