RECOMMENDATION: That the Common Council adopt Resolution No. 10786-090407, a resolution approving an amendment to the Warner CSM Development Agreement, which will provide provisions to reimburse the Developer for water main oversizing costs (Project No. 06072) (4th Aldermanic District).
BACKGROUND: At the time of approval and signature of the Warner CSM development agreement, it had not been determined that an oversized water main would be required for the Warner CSM development. Subsequently, in review of the proposed water main design, it was determined that a 12” water main, instead of an 8”, would be required. The amendment outlines the provisions whereby the Developer is to be reimbursed for installing an oversized water main to meet City of Oak Creek Water and Sewer Utility system requirements.
FISCAL IMPACT: The Developer pays the total initial construction cost. Reimbursement of the oversizing cost is through the Oak Creek Water and Sewer Utility.

WHEREAS, Aron and Sandra Warner, hereinafter referred to as the “Developer”, and the City, wish to amend the Warner CSM development agreement, and
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Development agreement for the Warner CSM is hereby amended and approved.
