Recommendation:  That the Council not adopt Ordinance No. 2469 requiring permits for accessory buildings 120 square feet in area or less.

 

Background:  City staff is requesting a zoning text amendment stating the need for a building permit for a garage or shed. Currently Chapter 17.0501(b)(7) states that garages and sheds less than 120 square-feet in area are not required to be issued a building permit. However, current policy requires residents to apply for a permit regardless of size. The purpose of requiring a building permit is to ensure residents follow the accessory structure regulations. The proposed change in code would state that detached garages, gazebos, garden or utility sheds require the issuance of a building permit in Section 17.0501(b). In addition, Section 17.0501(b)(7) pertaining to garages and sheds less than 120 square-feet would be repealed.

 

The Plan Commission has reviewed the requested zoning text amendment, and has recommended that it not be adopted.

 

Fiscal Impact:  The current practice of the Inspection Division is to require a zoning permit (with a fee of $15) for accessory structures 120 square feet in area or smaller.  If this practice is discontinued, there will be a loss of revenue.
