Recommendation:  That the Common Council adopt Resolution No. 10775-071707, accepting a storm sewer easement for Project No. 07021, storm sewer installation related to proposed sidewalk construction (Tax Key No. 875-9010)  (6th Aldermanic District).

 

Background:  The easement is necessary for the installation of a storm sewer inlet basin on private property.  The proposed storm sewer inlet is necessary to allow for the proposed public sidewalk to be constructed within the public right-of-way.

 

Fiscal Impact:  None.  The property owner is dedicating the new easement at no cost.

RESOLUTION ACCEPTING A STORM SEWER EASEMENT

AT 130 W. OAK LEAF DRIVE

 

(TAX KEY NO. 875-9010)

 

(6TH ALDERMANIC DISTRICT)

 

WHEREAS, the City of Oak Creek desires to construct, maintain and reconstruct, if necessary, storm sewer facilities at 130 W. Oak Leaf Drive (Tax Key No. 875-9010); and

 

WHEREAS, to enable the City to construct, maintain and reconstruct said facilities, it will be necessary that a easement be obtained from the affected property owner; and

 

WHEREAS, the storm sewer easement has been prepared affecting the following property owner, to wit:

Oak Leaf 130 LLC                                                 

130 W. Oak Leaf Drive                                          

Tax Key No. 875-9010

and such easement is attached hereto.

                                                                                                           

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached easement be approved and hereby accepted.

 

BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute the attached easement agreement on behalf of the Common Council of the City of Oak Creek, and upon the execution, the City Attorney being is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
