Recommendation:  That the Common Council adopt Resolution No. 107777-071707, a resolution approving and accepting a public sanitary easement dedication across the rear of  the property at 1157 W. Violet Drive, in the White Tail Ridge Subdivision (Tax Key No. 858-0025) (6th Aldermanic District).

 

Background:  On September 19, 2006, the Common Council approved the corresponding vacation and dedication of public sanitary sewer easements for the property at 1157 W. Violet Drive in the White Tail Ridge Subdivision.  The easement documents were recorded at the Milwaukee County Register of Deeds.  Subsequently, the property owners, Charles C. and Antoinette L. Williams, discovered that the easement document’s recording page had the wrong property owners name in the introductory paragraph.  This resolution will correct that error and allow for re-recording of the easement with the proper name.        

 

Fiscal Impact: None. The property owner is dedicating the new easement to the City at no cost.

RESOLUTION APPROVING DEDICATION OF A PUBLIC SANITARY SEWER EASEMENT

AT 1157 W. VIOLET DRIVE

 

(TAX KEY NO. 858-0025)

 

(6th ALDERMANIC DISTRICT)

 

WHEREAS, the Common Council had previously approved, on September 19, 2006, the vacation and dedication of lands for a public sanitary sewer easement at 1157 W. Violet Drive, Tax Key No. 858-0025, and,

 

WHEREAS, the introductory paragraph of the easement, which was recorded with the Milwaukee Register of Deeds on October 13, 2006 as Document No. 09320282, incorrectly identifies the grantor of the easement, and 

                                                                                                           

WHEREAS, the property owners and the City wish to correct the error in the introductory page of the public sanitary sewer easement for the property at 1157 W. Violet Drive.

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached public sanitary sewer easement, is hereby approved and accepted by the City.

 

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached public sanitary sewer easement on behalf of the Common Council of the City of Oak Creek and upon execution by the City of Oak Creek, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
