Recommendation: That the Common Council adopt Resolution No. 10776-071707, which would approve the future improvements agreement with John M. Coury of Summit Hill Construction, Inc., addressing future ultimate improvement and potential assessments affecting the Edgemont Estates Subdivision (Tax Key No. 958-9995-006) (5th Aldermanic District).
Background: John M. Coury is proposing to develop the Edgemont Estates Subdivision at 1640 E. Elm Road. It is impractical to install full public improvements under this development. Thus, as a condition of approval of the previously submitted and approved development agreement, the City is requiring the Developer to sign a future improvement agreement addressing the installation and assessment of the ultimate improvements affecting the proposed subdivision. The ultimate improvements for this RS-3 zoning are storm sewer, downstream storm drainage improvements, concrete curb and gutter, street lights, street trees and sidewalk. This agreement will be recorded with Milwaukee County Registrar of Deeds, which will assure that future property owners will be informed of this future improvement assessment requirement attached to the property.
Fiscal Impact: None currently. Impacts future development.

RESOLUTION APPROVING THE
EDGEMONT ESTATES FUTURE IMPROVEMENTS AGREEMENT WITH
JOHN M. COURY
(5th ALDERMANIC DISTRICT)
BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.
BE IT FURTHER RESOLVED that the Future Improvements Agreement attached hereto and incorporated herein by reference, by and between John M. Coury of Summit Hill Construction, Inc., as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
