Recommendation:  That the Common Council adopt Resolution No. 10774-071707, a resolution approving and accepting public sanitary sewer and public water main easements across the properties of Richard and Mary Fleck at 1125 E. Fitzsimmons Road (Tax Key No. 922-9037) and Edward and Denise Arnold at 1105 E. Fitzsimmons Road (Tax Key No. 922-9036) (5th Aldermanic District).

 

Background:  On June 19, 2007, the Common Council approved Ordinance No. 2460 amending the official map for the northeast and southeast ¼ of Section 28.  As a condition of approval Richard and Mary Fleck and Edward and Denise Arnold were to dedicate public sanitary sewer and public water main easements in the area of street right-of-way to be vacated.  This resolution and corresponding easement documents satisfy that condition requirement.

 

Fiscal Impact: None.  The property owners are dedicating the new easements at no cost.

RESOLUTION APPROVING PUBLIC SANITARY SEWER

AND PUBLIC WATER MAIN EASEMENTS

AT 1105 AND 1125 E. FITZSIMMONS ROAD

 

(TAX KEY NOS. 922-9038 AND 922-9037)

 

(5th ALDERMANIC DISTRICT)

 

WHEREAS, Richard and Mary Fleck and Edward and Denise Arnold are the property owners at 1105 and 1125 E. Fitzsimmons Road (Tax Key Nos. 922-9036 and 922-9037) and,

 

WHEREAS, the City requires that the Owners of said properties at 1105 and 1125 E. Fitzsimmons Road dedicate new public sanitary sewer and public water main easements as a condition of approval of City Ordinance No. 2460.

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached public sanitary sewer and public water main easements are hereby dedicated, approved and accepted by the City.

 

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached public sanitary sewer and public water main easements on behalf of the Common Council of the City of Oak Creek and upon execution by the City of Oak Creek, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
