Recommendation: That the Common Council approve the base bid proposal (and Alternates No. 16A & 16B if needed) from William Sackerson Construction to perform the Henry Miller Park pavilion addition and renovations in the amount of $179,200 (Project # 06030) (3rd Aldermanic District), and approve the transfer of approximately $38,349 from the 2006 Control Account to project # 06030.
Background: On July 31, 2006, the Common Council authorized $37,800 (later approved by Milwaukee County at $31,400) from the 2007 CDBG funding allocation for the use for the restrooms at the Henry Miller Park pavilion to make them handicapped accessible.
At their October 3, 2006 meeting, the Common Council authorized the use of previous years unexpended CDGB funds for their use in the renovation project. Balances in the various unexpended funds accounts totaled $139,411.14.
At their March 6, 2007 meeting, the Common Council approved entering into a contract agreement with The Architectural Workshop, LLC for design and construction services for the pavilion project.
In March, the 2007 Community Block Grant Agreement was executed between the City of Oak Creek and the Milwaukee County Department of Administration Services which approved the reallocation of the unexpended CDGB funds and additional 2007 CDGB funds of $31,400 for the pavilion renovation project.
At their April 2, 2007 meeting, the Parks, Recreation & Forestry Commission reviewed and approved a design presented by The Architectural Workshop, LLC. The main components of the accessibility renovation project include a nine foot building addition on the west side of the pavilion, relocation of appropriate utilities and a storm sewer pipe, replacement of and additional restroom fixtures and partitions, modify existing serving counter, replace existing entrance and access doors, provide exterior access doors to the restrooms, and provide an access sidewalk to the north restroom and entrance. (See enclosed existing and proposed floor plans).
The Architectural Workshop, LLC preliminary costs estimate for the addition and renovations were such that the project was bid out to include several alternates that were approved by Milwaukee County Department of Administration Services. These alternate accessible components and environmental enhancements would have included such components as an accessible ramp and pier to the pond, new energy efficient windows and furnace, new lighting, insulation of the building, etc. With the unexpected high bid proposal, the project will not include these alternates (with the exception on Alt.16A & Alt.16B). (See enclosed bid tabulation). Alternates can be budgeted and bid in the future if the City would like to make future renovations.

Unit Prices: As needed for unforeseen bad soil conditions, Owner will not pay for contractor error:
A. Unit price per cubic yard for materials and placement of imported structural granular fill, including compaction of 97% modified proctor: $50.00
B. Unit Price per cubic yard for materials and placement of lean concrete fill: $100.00
Request for bids were advertised in June with only one proposal being received. The bid proposal was evaluated by The Architectural Workshop, LLC, (letter of recommendation attached) and reviewed by the Director of Parks, Recreation & Forestry resulting in the above recommendation.
Fiscal Impact: Funds for this project will come from CDGB funding in the amount of $140,851 and from the 2006 Control Account in the amount of $38,349.
