Recommendation: That the Council adopt Resolution No. 10769-060507, which would approve the development agreement for the Edgemont Estates subdivision at 10670 S. Nicholson Road.
Background: Richard Coury is requesting approval of a development agreement for Edgemont Estates; a 12-lot subdivision in the Rs-3, Single Family Residential zoning district at 10670 S. Nicholson Road. The preliminary plat for this subdivision was approved by the Plan Commission on April 11, 2006. Because the platting of this subdivision would have resulted in the creation of a non conforming lot on the adjacent property, this preliminary plat was reviewed and approved by the Common Council (Resolution No. 10660-081506 – Sept. 5, 2006).
Development in the Rs-3 zoning district requires certain public improvements per the City’s Engineering Design Manual including curb, gutter, street lighting, and sidewalks. The applicant is proposing to install these improvements along the Edgemont Drive portion of this subdivision to the eastern end of the property. However they are not proposing these improvements along their frontage on E. Elm Road because curb, gutter, sidewalks, and street lighting do not exist on adjacent properties.
Fiscal Impact: This development will generate approximately $ 26,844 in impact and development fees as permits are issued.
