Recommendation: That the Council adopt Ordinance 2455 repealing and recreating various sections of Chapter 17 as it relates to the duties and responsibilities of the Zoning Administrator and Building Commissioner.
Background: In 2006 the Common Council created the position of Zoning Administrator. The Zoning Administrator is responsible for enforcement of several provisions of Chapter 17, the City’s Zoning Ordinance. Within that ordinance there are several references to the duties and responsibilities of the Building Commissioner. Since the Zoning Administrator position was created staff has worked with the City attorney to create this ordinance which would replace or add Zoning Administrator to all applicable duties. In addition to these changes a reference to a state statute under Section 17.0321(e)(7) as it relates to the construction, reconstruction, maintenance and repair of state highways and bridges was updated to reflect the current state statutes.
The public hearing for this amendment was held at the April 17, 2007 meeting where the Common Council held this item until the Plan Commission could review it. At the April 24, 2007 meeting the Plan Commission reviewed this ordinance and recommended its approval. The Plan Commission made one modification to the ordinance as it relates to who has the duty of interpreting the Zoning Ordinance. This change is reflected in the attached ordinance.
Fiscal Impact: The amendment of this zoning code would have a negligible fiscal impact.
