Recommendation:  That the Common Council adopt Resolution No. 10751-041707, establishing special assessment rates.     

 

Background:  The Engineering Department and the Oak Creek Water and Sewer Utility have recently reviewed the existing assessment rates that were adopted December 3, 2002 and recommend updating the rates for all underground utility installations and street construction.

 

It is recommended that these rates remain in effect until adjustments are identified based on a future review conducted by the Engineering Department and the Water and Sewer Utility.

 

FISCAL IMPACT:  None at this time.

RESOLUTION ESTABLISHING SPECIAL ASSESSMENT RATES

 

WHEREAS, pursuant to Section 66.0701, Wisconsin Statutes, and Chapter 3.200 of the City of Oak Creek Municipal Code, the governing body of any city is empowered to levy and collect special assessments upon property in a limited and determinable area for special benefits conferred upon such property by any municipal work or improvement, and

 

WHEREAS, said section also provides that any amount assessed against any property for any work or improvement shall not exceed the value of the benefits accruing to the property therefrom or shall be upon a reasonable basis as determined by the governing body of the City, and

 

WHEREAS, the Common Council of the City of Oak Creek proposed to establish uniform and equitable maximum assessment rates to be levied and assessed for certain public improvements.

 

NOW, THEREFORE, BE IT RESOLVED that in accordance with and pursuant to the authority granted in Section 66.0701, Wisconsin Statutes, the following maximum assessment rates be and they are hereby established for the following enumerated categories of public improvements to be levied and assessed.

*These rates shall not exceed $3,500/acre being served.

 

Inasmuch as it is impossible to establish a maximum assessment rate of the enclosure of a watercourse or a storm drainage course on large tracts of land to serve or accommodate planned developments, special uses, etc., it is hereby declared to be the policy of the Common Council to share in the costs of such enclosure with the developer with the pro-rata share of such costs (assessments) to be determined on a reasonable and fair basis and set forth in a development agreement between the city and the developer.

 

All rates are per lineal foot of abutting property frontage, unless otherwise noted.

All rates are per lineal foot of abutting property frontage.

 

1 Grading, asphalt street pavement and concrete street pavement assessment rates pertain to half-street pavement width (i.e. the rate for a 24’ width pavement applies only to a 12’-wide half pavement width).

 

2 The special assessment rates for asphalt and concrete street pavements include crushed stone subbase, but do not include grading, curb & gutter, sidewalk, driveway approaches, street lighting, or storm sewer, which have their own separate rates established in this resolution.

 

3 Curb & gutter assessment rate includes perforated curb underdrain system.

 

Commercial and industrial street improvements shall be special assessed up to 100% construction cost plus 15% for engineering and administration.

 

 

                                                   MISCELLANEOUS IMPROVEMENTS

 

Sidewalk repair and replacement – construction cost plus 15% for engineering and administration costs.

 

Driveway approach - construction cost plus 15% for engineering and administration costs.

 

Streetlights – construction cost plus 15% for engineering and administration costs.
