City of Oak Creek

Common Council Report

 Meeting Date:  May 1, 2007

Item No.:

Recommendation:  That the Common Council approve the recommendation of the

Small Claims Committee and the Street Superintendent to revisit the Common Council policy dated February 19, 2001 relating to mailbox claims.

Background: There are new subdivisions in the City of Oak Creek in which the developer mandates the type of mailbox that is to be used by property owners.  Georgetown Commons West deed restrictions are attached as an example.  The Common Council Report dated February 19, 2001 was approved and indicates that the City will not reimburse more than $150.00 per mailbox.

The Street Department is finding that when one of these developer-specified mailboxes is damaged by snow removal equipment, the cost exceeds the $150.00 policy set at the February 19, 2001 Common Council meeting, and the property owner files a claim with the Small Claims Committee.

A survey of surrounding communities was done by the City of Brookfield in February of 2005 indicating the reimbursement procedures for damaged mailboxes.  A copy is attached, with some updated figures where available.
