Recommendation: That the Council adopt Ordinance No. 2452 authorizing the amendment of the conditional use permit for the property at 840 W. Ryan Road to allow for the outdoor storage of vehicles and equipment subject to conditions and restrictions.

 

Background:  During the course of a Plan Commission review of a request for a sign by Ryan Road Storage, it was discovered that they were storing rental trucks and vans on site, which was not allowed under the terms of their conditional use permit issued in October of 2002.  After that meeting the applicant submitted an application to amend the conditional use permit to allow for outdoor storage of no more than five (5) moving trucks, vans or trailers for rent.

 

Staff, as well as the Plan Commission, is comfortable with amending the conditional use permit to allow for the outdoor storage of these moving trucks as long as the trucks are not visible from W. Ryan Road.  Currently they are storing at least two (2) of the trucks at the southwest corner of the fenced in area on the property.  These trucks are in plain view of W. Ryan Road.  There are other areas onsite, including the area behind the office building and between a number of the mini-warehouse buildings which could accommodate these trucks while providing adequate screening.  A site plan showing acceptable storage areas is included with the original Plan Commission report, a copy of which is included.

 

An amended version of the conditions and restrictions for this request has been recommended for approval by the Plan Commission.  These conditions and restrictions limit the number of trucks that can be stored on site and requires that they are stored in areas that are not visible from W. Ryan Road. All changes have been highlighted using bold lettering.

 

Fiscal Impact:  The amendment of this conditional use permit would have a negligible fiscal impact.
