Recommendation:  That the Common Council consider approval of an amended Conditional Use Permit with LePine Enterprises Inc. for the property at 9540 and 9578 S. Pennsylvania Avenue. 

Background:  This matter has been the subject of a revocation hearing before the Common Council.  On March 22, 2007 the Common Council considered the terms of an amended conditional use permit and engaged in negotiations with Bruce LePine and his attorney.  Attached is the form of a red-lined amended conditional use permit that has been presented to Mr. LePine’s attorney.  The red-lining represents the differences between the original conditional use permit and the amended conditional use permit.  Negotiations are continuing and will likely continue until Monday April 2, 2007.  In the event that the parties agree to a modified form of the amended conditional use permit a copy will be provided to Council members as soon as possible. 

Fiscal Impact:  No fiscal impact.
