Recommendation: That the Common Council adopt Resolution No. 10753-041707 authorizing the vacation of an existing storm drainage easement adjacent to the east property line of 520 E. Marquette Avenue (Tax Key No. 781-0175) (1st Aldermanic District).
Background: There are two storm drainage easements along the east property line of 520 E. Marquette Avenue. The original storm drainage easement was 10’ wide along the entire east property line and was part of the original subdivision plat for Sleepy Hollow Addition No. 2. The other easement (overlay easement) was recorded with the Milwaukee County Register of Deeds on October 30, 1990 as Document No. 6431445, on Reel 2506 as Images 31 to 33, inclusive, and is also along the east property line. The overlay easement is no longer necessary given the storm water plan for the Mahn Court Development.
The most recent easement will be vacated while the original storm drainage easement will remain.

RESOLUTION AUTHORIZING THE VACATION OF
A STORM DRAINAGE EASEMENT
AT 520 E. MARQUETTE AVENUE
(TAX KEY NO. 781-0175)
(1ST ALDERMANIC DISTRICT)
WHEREAS, a storm drainage easement was granted to the City of Oak Creek, recorded with the Milwaukee County Register of Deeds on October 30, 1990 as Document No. 6431445, on Reel 2506 as Images 31 to 33, inclusive, and
WHEREAS, the original 10-foot storm drainage easement along the east property of the property described as Lot 7, Block 13 in Sleep Hollow Addition No. 2 being a subdivision of a part of the NE ¼ and NW ¼ of the SW ¼ and part of Lot 1 CSM 69, being a part of the SE ¼ of the NW ¼ Section 9, Town 5 North, Range 22 East, in the City of Oak Creek, Milwaukee, Wisconsin will remain after vacation of the storm drainage easement granted to the City of Oak Creek on October 30, 1990.
NOW, THEREFORE BE IT RESOLVED by the Mayor and the Common Council of the City of Oak Creek that said storm drainage easement is hereby vacated, and
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to cause a certified copy of this resolution to be recorded in the office of the Register of Deeds in and for Milwaukee County, Wisconsin.
