Recommendation:  That the Common Council adopt Resolution No. 10756-041707, a resolution approving and accepting a public sanitary sewer easement and a conservation easement  across the rear portion of the Sikh Temple property at 7502 and 7512 S. Howell Avenue. (Tax Key Nos. 781-9994 and 781-9995 (1st Aldermanic District).

 

Background:  The sanitary sewer easement is centrally located over the newly installed public sanitary sewer which serves the newly constructed Sikh Temple.  The conservation easement is located on the rear open space and detention pond area of the Sikh Temple property.  At the June 27, 2006 Plan Commission meeting, approval of site and building plans for the Sikh Temple had the provision: “That an open space easement for the eastern ¼ of the property is approved by the Common Council.”  The conservation easement satisfies that provision.   .       

 

Fiscal Impact: None.  The property owner is dedicating the new easements at no cost.

RESOLUTION APPROVING CONSERVATION AND PUBLIC SANITARY SEWER EASEMENTS

AT 7502 AND 7512 S. HOWELL AVENUE

 

(TAX KEY NOS. 781-9994 AND 781-9995)

 

(1ST ALDERMANIC DISTRICT)

 

WHEREAS, Sikh Temple is the owner of certain properties at 7502 and 7512 S. Howell Avenue (Tax Key Nos. 781-9994 and 781-9995) and,

 

WHEREAS, the City requires that the Owner of said properties at 7502 and 7512 S. Howell Avenue dedicate a new public sanitary sewer easement for the new public sanitary sewer constructed to serve the newly constructed Sikh Temple and,

 

WHEREAS, the City of Oak Creek Plan Commission, at their June 27, 2006 meeting  required dedication of open space on the rear eastern ¼ of their property at 7502 and 7512 S. Howell Avenue, as a condition of approval.  

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached public sanitary sewer easement and conservation easement, are hereby dedicated, approved and accepted by the City.

 

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached public sanitary sewer easement and conservation easement on behalf of the Common Council of the City of Oak Creek and upon execution by the City of Oak Creek, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
