Recommendation: That the Common Council adopt Resolution No. 10760-041707, which would approve the Oak Creek-Franklin School District development agreement for the construction of compensating storage facilities for the new middle school at 9330 S. Shepard Avenue (Tax Key No. 873-9978) (3^rd Aldermanic District).

Background: The Oak Creek-Franklin School District is constructing a new middle school at 9330 S. Shepard Avenue. The new building and grounds are part of an approved storm water management plan that requires compensating storage. This agreement will provide the City with assurance that compensating storage will be completed prior to the issuance of a building permit.

RESOLUTION APPROVING THE

OAK CREEK-FRANKLIN SCHOOL DISTRICT MIDDLE SCHOOL

COMPENSATING STORAGE AGREEMENT

(3^RD ALDERMANIC DISTRICT)

BE IT RESOLVED that Chapter 14 of the Municipal Code requires that an agreement be entered into first prior to the required improvements being installed.

BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Oak Creek – Franklin School District, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
