RESOLUTION AUTHORIZING WISCONSIN ELECTRIC TO PLACE PUBLIC UTILITY STRUCTURES UPON THE BED OF LAKE MICHIGAN

 

(4th Aldermanic District)

 

            WHEREAS,     Wisconsin Energy Corporation (“WEC”)and Wisconsin Electric Power Company (“Wisconsin Electric”), as part of its Power the Future plan announced in 2000, have committed to improving its existing power plants by installing air quality control systems and related equipment to reduce air emissions thereby improving the quality of air in Southeastern Wisconsin, and

 

WHEREAS, in conjunction with its Power the Future plan, Wisconsin Electric will file an application with the Public Service Commission for approval to construct and place in service air quality control systems and related equipment at the Oak Creek Power Plant Units 5-8 and an application with the Department of Natural Resources authorizing the placement of the aforementioned public utilities structures under Wis. Stats. § 30.21, and

 

WHEREAS,  Oak Creek Power Plant was constructed in the 1950s and 1960s and as part of that construction of plant, Wisconsin Electric was authorized to fill in the lakebed along the shore of where the plant is currently situated, and

 

WHEREAS, a portion of the proposed air quality control systems and related equipment that will be installed at the Oak Creek Power Plant will be located in the City of Oak Creek on the authorized lakebed fill, and

 

WHEREAS, as a part of the construction of the air quality control systems and related equipment at the Oak Creek Power Plant, some of the equipment may be brought into the site via Lake Michigan which will require harbor facilities in the form of temporary pilings to be placed in the lake in order to facilitate the delivery of the equipment, and 

 

WHEREAS, Wisconsin Statutes §30.21 authorizes Wisconsin Electric to place public utility structures as well as harbor facilities upon and in the bed of Lake Michigan for public utility purposes subject to the City of Oak Creek granting a permit by virtue of a resolution for the placement of public utility structures and harbor facilities, and

 

NOW THEREFORE, BE IT RESOLVED, the Common Council of the City of Oak Creek hereby grants a permit to Wisconsin Electric to place public utility structures upon the bed of Lake Michigan, and

 

BE IT FURTHER RESOLVED that the construction of the public utility structures is subject to the approval of the appropriate State agencies and Federal agencies, as required.
