Recommendation: That the Council consider Ordinance No. 2448, rezoning portions of the properties at 10625 & 10590 S. Emerald Meadows Drive and 3600, 3660 & 3620R E. Elm Road to reflect the new FF, Flood Fringe Overlay District boundaries, after a public hearing.
Background: The developers of the Emerald Meadows Addition No. 2 subdivision are requesting a rezoning of lands from Rs-2, Single Family Residential to FF, Flood Fringe and from FF, Flood Fringe to Rs-2, Single Family Residential to reflect the new flood fringe boundaries created with the construction of the subdivision. Included with this staff report are maps of the existing and proposed flood fringe boundaries. Staff would like the zoning boundaries amended prior to the final plat being recorded to prevent a situation where future property owners are shown in the flood fringe when they are actually out, as it could result in lenders requiring flood insurance.
The approved grading plan for this development used flood volume compensation areas which allowed them to move the flood fringe boundary lines. Flood volume compensation is allowed under Section 17.0323 of the Zoning Ordinance as long as the compensation is at a rate of 1.10 to 1 of the volume of storage. The compensation was approved with the grading plan for the subdivision. The developers have submitted the grade certifications that confirm that the grading was completed as approved.
The Plan Commission has reviewed this rezoning request and has recommended that the Common Council approve the rezoning after a public hearing.
