Recommendation:  That the Common Council adopt Resolution No. 10743-032007, which would approve the development agreement with Woodman’s Food Market, Inc., (Developer) for the installation of public water main that will accommodate their building plans at 7929 and 8201 S. Howell Avenue (Tax Key Nos. 813-9011 and 813-9909-004) (City Project No. 07052) (2^nd Aldermanic District).

Background:  Woodman’s Food Market, Inc. is constructing a new food market at 7929 and 8201 S. Howell Avenue.  The new building will necessitate construction of public water main along their S. Howell Avenue frontage.  This agreement will provide the City with the authority to direct and control the design and construction of the required public water main to ensure they meet City codes and specifications.

Fiscal Impact:  None. Developer pays for all design and installation costs.

RESOLUTION NO. 10743-032007

RESOLUTION APPROVING THE

DEVELOPMPENT AGREEMENT WITH

WOODMAN’S FOOD MARKET, INC.

(2ND ALDERMANIC DISTRICT)

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

            BE IT FURTHER RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by and between Woodman’s Food Market, Inc., as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 20^th day of March, 2007.
