Recommendation:  That the Common Council adopt Resolution No. 10744-032007, a resolution approving a General Utility and Access Easement for Colonial Woods (Tax Key Nos. 810-9012 & 810-9013) (2nd Aldermanic District).

 

Background:  The Oak Creek Water and Sewer Utility requires access to the last sanitary sewer manhole before the sewer enters the woods and runs to S. 20th Street for maintenance.  The proposed layout would not accommodate the Utility’s vacuum truck to turn around at the end.  The new proposal loops an access path around the storm water retention pond.  This requires the additional general utility and access easement to provide the coverage of the new loop.

RESOLUTION APPROVING A GENERAL UTILITY AND ACCESS EASEMENT

FOR COLONIAL WOODS

 

(TAX KEY NOS. 810-9012 & 810-9013)

 

(2ND ALDERMANIC DISTRICT)

 

WHEREAS, Colonial Woods Limited Partnership (Owner), requires a general utility and access easement, and,

 

WHEREAS, the City requires that the Owner provide access to the sanitary sewer and storm water appurtenances, and,

 

WHEREAS, the required General Utility and Access Easement has been prepared and signed by the Owner,

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached General Utility and Access Easement, as signed by the Owner, is hereby approved by the City.

 

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached agreement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Owner, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
