City of Oak Creek
Common Council Report
Meeting Date: 02/06/07
Item No.:
Recommendation:
Informational: Mayoral Proclamation of Declaration of Status of the City of Oak Creek as a City of the Third Class.
Background:
According to Wis. Statutes, Sec. 62.05, Wisconsin cities are divided into four classes for administration and the exercise of corporate powers, as follows:
Class Population
1 150,000+
2 39,000+ to150,000
3 10,000+ to 39,000
4 under 10,000
The criterion for passing from one class to the next takes place upon a change in population verified by the last federal census, and becomes officially declared upon a published proclamation by the mayor. Oak Creek passed the10,000 population mark after the 1970 census, with a population of 13,928, but according to the Wisconsin Legislative Reference Bureau, no official mayoral proclamation was ever filed with that office. A review of the City’s archived records also could not produce a verification, so a Mayoral Proclamation is being declared and published now.
The City has been operating under the administrative and corporate powers, and abiding by the legal requirements of a third-class city, and now this designation can officially appear in the state record.
