Recommendation: That the Council file Resolution No. 10547-092005 and adopt Resolution No. 10736-020607 approving the certified survey map for Gary and Steve Kraeger for the properties at 6701 & 6721 S. 20th Street.
Background: The applicant is requesting approval of a certified survey map for the property at 6701 & 6721 S. 20th Street. This certified survey map will create four (4) lots in the Rs-4, Single Family Residential zoning district. Lots in the Rs-4 district require a minimum lot area of 10,000 square feet and a minimum lot width of 75 feet (85 feet for corner lots). Each of the lots meets or exceeds these requirements.
The Plan Commission reviewed this request at the August 23, 2005 meeting. The Plan Commission recommended that the Common Council not approve the certified survey map because of concerns about how one of the lots would be graded. The Plan Commission also had indicated a preference for three (3) lots instead of four (4). Shortly after, the City Attorney issued an opinion that since the certified survey map met all of the dimensional and area requirements of the Rs-4 zoning district that the Plan Commission could not deny the map based on concerns about site grading and preference for three (3) lots instead of four(4).
The Common Council held this item at the September 20, 2005 meeting so the applicant could enter into a development agreement with the City for the required public improvements. As part of this motion, the Council should file Resolution No. 10547, the initial approval resolution in 2005). The development agreement was approved by the Common Council on December 20, 2005. The public improvements are installed and have been certified as complete by the Engineering Department and Water and Sewer Utility, so the map can be presented to the Common Council for final approval.
Fiscal Impact: This land division will generate $8392 in impact and development fees as permits are issued for homes to be built on these lots.
