Recommendation:  That the Council adopt Resolution No. 10734-020607 approving the certified survey map for Anthony Sanfelippo for the properties 3280 & 3310 E. Kender Lane

 

Background:  In 1995 a 3-lot (and 1 outlot) certified survey map (CSM) for the properties at the end of E. Kender Lane was approved by the Plan Commission and Common Council. A development agreement was entered into between the City and the owners for the required public improvements in E. Kender Lane, including construction of a permanent cul-de-sac and installation of sanitary sewer, water, and storm sewer.  The improvements were not completed but the CSM was recorded on January 23, 1998

 

On February 7, 2006 the Common Council approved a new development agreement with the property owner for the required Kender Lane improvements.  Additionally, a stormwater pond was required to be constructed to serve this development.  The stormwater pond needs to be placed in an outlot, so the applicant is submitting the proposed CSM to create the stormwater outlot  (Outlot 2 on the CSM). Outlot 1 will be retained by the developer for possible future development or sale to an adjacent property owner.  When the CSM was originally approved the minimum lot width was 75 feet.  Since they are doing a new land division, the lot width of Lot 1 was increased to 80 feet, which is the current minimum lot width in the Rs-3 zoning district. All required public improvements have been installed and certified as complete by the Water & Sewer Utility and Engineering Department.

 

The Plan Commission reviewed this certified survey map at the January 23, 2007 meeting and has recommended its approval.

 

Fiscal Impact:  This land division will generate $1832 in impact and development fees as permits are issued for homes to be built on these lots.
