Recommendation:  That the Common Council adopt Resolution No. 10799-110607, accepting a temporary cul-de-sac easement for Project No. 06060, cul-de-sac installation related to Phase 1 construction of Colonial Woods Condominiums (Tax Key Nos. 810-9012 and 810-9013)  (2nd Aldermanic District).

 

Background:  The easement is necessary for the installation of a temporary cul-de-sac on private property at the north end of S. Orchard Way.  The proposed temporary cul-de-sac is required to allow vehicles a safe place to turn around at the end of Phase 1 construction.  South Orchard Way will be extended north in Phase 2 and the temporary easement will be abandoned.

 

Fiscal Impact:  None.  The property owner is dedicating the new easement at no cost.

RESOLUTION ACCEPTING A TEMPORARY CUL-DE-SAC

EASEMENT ALONG S. ORCHARD WAY  

 

(TAX KEY NOS. 810-9012 and 810-9013)

 

(2ND ALDERMANIC DISTRICT)

 

            WHEREAS, Colonial Woods Limited Partnership is required to construct a temporary cul-de-sac at the north end of S. Orchard Way (Tax Key Nos. 810-9012 and 810-9013); and

 

            WHEREAS, to enable the City to maintain and reconstruct, if necessary, said facilities, it will be necessary that a easement be obtained from the affected property owner; and

 

            WHEREAS, the temporary cul-de-sac easement has been prepared affecting the following property owner, to wit:

 

Colonial Woods Limited Partnership

309 N. Water Street, Suite 315                             

Tax Key Nos. 810-9012 and 810-9013

 

and such easement is attached hereto.

                                                                                                           

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached easement be approved and hereby accepted.

 

            BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute the attached easement agreement on behalf of the Common Council of the City of Oak Creek, and upon the execution, the City Attorney being is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
