Recommendation:  That the Common Council approve the Renewal of the Intergovernmental Agreement to Provide Sanitarian Services Between the Cities of Oak Creek and Franklin.

 

Background:  On April 2, 2007, the Oak Creek Common Council approved the Intergovernmental Agreement to provide Sanitarian Services between the cities of Oak Creek and Franklin.  This arrangement has worked out for both communities.  The City of Franklin will be applying to the State for Agent Status beginning in 2008.  In order to achieve that goal, Franklin has requested to increase the services of the Registered Sanitarian hours from eight (8) per week to up to an average of sixteen (16) hours per week.  Both Health Officers and City Administrators have met to discuss and agree upon the new Intergovernmental Agreement.

 

On November 6, 2007 the Franklin Common Council approved the Intergovernmental Agreement as attached.

 

The Intergovernmental Agreement attached has been reviewed by the Oak Creek City Attorney, Lawrence Haskin for legal sufficiency. 

 

There have been four changes to this document from the 2007 Agreement:

 

# 2.  Sharing services with Franklin:  the amount of contracted hours increased from eight to “an average of sixteen (16) hours per week”;

 

# 5.  Training.  “Oak Creek and Franklin agree that it is vital that the sanitarian receive professional training in order to provide an appropriate level of service to its citizens.  Franklin and Oak Creek shall share in the cost of training that is mutually agreed to by the Sanitarian’s immediate supervisor in Oak Creek and Franklin.  In the event that either City believes certain training is appropriate for the Sanitarian, but the other City disagrees, the approving City shall be responsible for the cost of said training.  If Franklin approves the training, but Oak Creek does not, the Sanitarian may only attend the training if consented to, although not necessarily approved by Oak Creek”:

 

# 7. Term of Agreement  added “The term of this agreement shall begin on January 1, 2008, and shall continue for an indefinite period of time”  and increased the termination of this agreement from thirty (30) days to ninety (90) and to read:  “This Agreement may be terminated by either party upon ninety (90) days written notice to the other party, provided that if there is an unexpected or unanticipated separation of employment between the Sanitarian and Oak Creek that does not allow Oak Creek to provide 90 days written notice to Franklin, this agreement may be terminated by Oak Creek effective on such date as the Sanitarian separates from employment with Oak Creek.

 

Both Cities will have the right to recall the Sanitarian in the event of an emergency. 

 

Fiscal Impact:  Allowing the contract arrangement will produce approximately $3,200 in monthly revenue.
