Recommendation:  That the Common Council adopt Resolution No. 10804-112007, authorizing a Quit Claim Deed to provide additional City right-of-way for Opus Drive in the Oakwood Crossings Business Park (Project No. 06063) (Tax Key No. 924-9003) (5th Aldermanic District).

 

Background:  Construction of Opus Drive in the Oakwood Crossings Business Park requires additional right-of-way to properly locate Opus Drive within standard street right-of-way width. The area where the additional right-of-way is required is located on a City parcel (see attached map).  A Quit Claim Deed is the proper transfer mechanism to dedicate City property for City right-of-way.

 

Fiscal Impact:  None.  The City is dedicating City-owned property for City right-of-way at no cost.

RESOLUTION AUTHORIZING A QUIT CLAIM DEED FOR OPUS DRIVE RIGHT-OF-WAY

IN OAKWOOD CROSSINGS BUSINESS PARK

 

(TAX KEY NO. 924-9003)

 

(5TH ALDERMANIC DISTRICT)

 

            WHEREAS, the City of Oak Creek has constructed Opus Drive in the Oakwood Crossings Business Park, (Tax Key No. 924-9003); and

 

            WHEREAS, to enable standard street alignment and standard location of the street within City right-of-way, it is necessary to dedicate a portion of the City parcel abutting Opus Drive in the  Oakwood Crossings Business Park for street purposes; and

 

            WHEREAS, the proper mechanism to accomplish this dedication is a Quit Claim Deed.

                                                                                                           

            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached Quit Claim Deed be approved and is hereby accepted.

 

            BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute the attached Quit Claim Deed on behalf of the Common Council of the City of Oak Creek, and upon the execution, the City Attorney being is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
