Recommendation:  That the Council adopt Resolution No. 10721-010307 approving the final plat for the Shepard Orchard subdivision.  

 

Background:  The applicant is requesting approval of the Final Plat for the Shepard Orchard Subdivision. This final plat will create 48 lots in the Rs-2, Single Family residential zoning district. The original preliminary plat was approved by the Plan Commission on February 8, 2005.  Lots in this district require a minimum lot area of 17,000 square feet and a minimum lot width of 100 feet (110 for corner lots).  Each of these lots exceeds this requirement.  It should be noted that two (2) additional lots will be created at the time that S. Macintosh Lane and S. Spartan Lane are extended to the north.  These lots (Outlots 3 &4) will remain outlots with temporary turn-around easements on them until that time.

 

The final plat substantially conforms to the preliminary plat. The public improvements have been certified as complete by the Engineering Department, the Streets Department, and the Water and Sewer Utility.  However the Utility has a concern with the sewer line slope as constructed.  They will therefore require a letter acknowledging the developer’s responsibility for this sewer, including periodic cleaning, cleaning required by the Utility, and liability incurred as a result of a sewer back-up caused by this line until they are released from their development agreement

 

The Plan Commission held this item at the December 12, 2006 meeting because some adjacent property owners felt that the stormwater runoff from this development was ending up on their properties.  The Engineering Department has visited the site and has determined that the grading was completed as approved and that the drainage issues brought up at the last meeting have been resolved.  The Plan Commission will hold a special meeting on January 3, 2007 before the Common Council meeting.  It is anticipated that they will recommend approval of the Final Plat at this meeting.

 

Fiscal Impact:  This subdivision will generate $106,224 in impact and development fees as permits are issued for homes to be built on these lots.
