Recommendation: That the Council adopt Resolution No. 10660-081506 conditionally approving the preliminary plat for Edgemont Estates subdivision.
Background: This preliminary plat for the Edgemont Estates subdivision at 10670 S. Nicholson Road will create 12 lots in the Rs-3, Single Family Residential zoning district. Lots in this district require a minimum area of 12,000 square feet and 80 feet of lot width (90 for corner lots). The applicant is far exceeding the minimums of this zoning district by providing lots ranging in size from 19,007 square feet (.44 acres) to 21,980 square feet (.50 acres). The preliminary plat approved by the Plan Commission had 14 lots. After meeting with staff and Alderwoman Grabowski, the applicant agreed to remove two (2) lots on E. Elm Road. This area will be an outlot, retained by the developer, that could possibly be used for two (2) future residential parcels, provided utilities are extended and stormwater management regulations can be met. Any further division of this land would require City of Oak Creek approval.
Typically preliminary plats only need Plan Commission approval, however Section 14.62 of the City’s Land Division and Platting ordinance requires Common Council approval for any preliminary plats that makes a principal structure on lands that adjoins or abuts any street within the preliminary plat non-conforming as to setbacks. The creation of this preliminary plat will result in the home at 10640 S. Nicholson Road becoming a legal non-conforming structure. This property is located just north of Edgemont Drive. The installation of Edgemont Drive will result in this property becoming a corner lot, which requires a street yard setback of 30 feet. Once the right-of-way is dedicated, the house would have a street yard setback of 12 feet.
The Plan Commission has considered this request and has recommended its approval, subject to the following conditions:
Fiscal Impact: This subdivision will generate approximately $26,844 in impact and development fees as permits are issued for homes to be built on these lots.
Recent data has suggested that any homes constructed on the newly created parcels would need to have an assessed value in excess of $249,577 in order to generate revenues equal to costs.
