RESOLUTION APPROVING A PRELIMINARY

PLAT FOR THE EDGEMONT ESTATES SUBDIVISION

 

10670 S. Nicholson Road

 (5th Aldermanic District)

 

                        WHEREAS, it appears that the preliminary plat for Edgemont Estates, submitted by JOHN COURY, hereinafter referred to as the subdivider, is in compliance with all statutory requirements; and

 

                        WHEREAS, the subdivider has complied with all of the applicable ordinances and resolutions of the City of Oak Creek, and

 

                        WHEREAS, the Plan Commission, at their meeting of April 11, 2006 has recommended that this preliminary plat be approved subject to the following conditions,

 

  1. That a development agreement be entered into between the owner and the City to specify the responsibility for and the timing of public improvements.
  2. That the final utility plans are approved by the Water & Sewer Utility.
  3. That grading, drainage and stormwater management plans are approved by the City Engineer.
  4. That any technical corrections are made prior to final plat submittal.

and,

 

WHEREAS, The dedication of right of way within this preliminary plat would result in the home at 10640 S. Nicholson Road becoming a legal non-conforming structure due to an insufficient street yard setback.

 

WHEREAS, Section 14.62 of the City’s Land Division and Platting ordinance requires Common Council approval for any preliminary plat that makes a principal structure on lands that adjoin or abut any street within the preliminary plat non-conforming as to setbacks. 

 

 

WHEREAS, Chapter 14 of the Municipal Code also requires that a development agreement be entered into prior to the required public improvements being installed; and,

 

WHEREAS Chapter 14.101(f) of the Municipal Code also requires that the subdivider of certain parcels enter into an agreement with the City related to the cost of future public improvements; and,

 

                        NOW, THEREFORE, BE IT RESOLVED that this preliminary plat, in the City of Oak Creek, Wisconsin, is hereby conditionally approved by the Common Council.

 

                        BE IT FURTHER RESOLVED that a development agreement is entered into between the subdivider and the City to specify the responsibility for and timing of any public improvements; and,

 

                        BE IT FURTHER RESOLVED that the final utility plans shall be approved by the Water & Sewer Utility; and,

                       

                        BE IT FURTHER RESOLVED that grading, drainage and stormwater management plans shall be approved by the City Engineer.; and,

 

                        BE IT FURTHER RESOLVED that any technical corrections are made prior to final plat submittal.
