Recommendation:  That the Common Council adopt Resolution No. 10671-090506, which would approve the future improvements agreement with Ronald J. Rosen and Therese A. Wallschlaeger, addressing future ultimate improvement and potential assessments affecting the Abendschein and Wallschlaeger Certified Survey Maps (CSM) at 9865 and 9905 S. Shepard Avenue (Tax Key Nos. 907-9975-001, 923-9005-001) (5th Aldermanic District).

 

Background: George and Alice Abendschein, Ronald J. Rosen and Therese A. Wallschlaeger propose to develop three separate CSM’s at 9865 S. Shepard Avenue, 9905 S. Shepard Avenue and 560 E. Fitzsimmons to create ten residential lots.

 

It is impractical to install full public improvements in S. Shepard Avenue under this development.  Thus, as a condition of approval of the CSM’s, the City is requiring the Developer to sign a future improvement agreement addressing the installation and assessment of the ultimate improvements affecting the CSM’s.  The ultimate improvements for the CSM’s RS-3 zoning is storm sewer, storm channels, downstream storm drainage improvements, concrete curb and gutter, street lights, street trees and sidewalk.  This agreement will be recorded with Milwaukee County Registrar of Deeds, which will assure that future property owners will be informed of this future improvement assessment requirement attached to the property.

 

Fiscal Impact:  None currently.  Impacts future development.

RESOLUTION APPROVING THE

FUTURE IMPROVEMENTS AGREEMENT WITH

RONALD J. ROSEN AND THERESE A. WALLSCHLAEGER

 

(5th ALDERMANIC DISTRICT)

 

            BE IT RESOLVED that Chapter 14 of the Municipal Code requires that a development agreement be entered into first prior to the required public improvements being installed.

 

            BE IT FURTHER RESOLVED that the Future Improvements Agreement attached hereto and incorporated herein by reference, by and between Ronald J. Rosen and Therese A. Wallschlaeger, as party of the first part, and the CITY OF OAK CREEK, as party of the second party, be and the same is hereby approved.
