Recommendation: That the Council adopt Resolution Nos. 10664-090506, 10665-090506 and 10666-090506 approving certified survey maps (CSM’s) for the properties at
9865 S. Shepard Avenue, 9905 S. Shepard Avenue and 560 E. Fitzsimmons Road (Tax Key Nos. 907-9973-001, 907-9035 and 923-9005-001) (5th Aldermanic District)
Background: The applicants, Abendschein, Rosen and Wallschlaeger, are requesting approval of three CSM’s that will create ten parcels total in an Rs-3, Single Family Residential zoning district. Lots in this district require a minimum lot width of 80 feet (90 for corner lots) and 12,000 square feet in lot area. These lots exceed the minimum requirements.
Per City policy, the CSM’s may not be recorded until all required public improvements have been installed and certified complete by the City Engineer.
The applicants are requesting that the Abendschein CSM be approved and recorded at this time to allow Mr. Abendschein the opportunity to sell the existing home on Parcel 1. The remaining Parcels 2 and 3 of the Abendschein CSM will be restricted under a development agreement to the requirement that they may not receive a building permit until the Rosen and Wallschlaeger CSM’s have been recorded and the CSM’s cannot be recorded until the public improvements are installed. The development agreement is proposed to be with Rosen and Wallschlaeger.
The Plan Commission has reviewed this request and recommended its approval.
Fiscal Impact: Data has suggested that any homes constructed on the newly created parcel would need to have an assessed value in excess of $249,577 in order to generate revenues equal to costs.

RESOLUTION APPROVING A CERTIFIED SURVEY MAP

WHEREAS, it appears that the certified survey map submitted by GEORGE AND ALICE ABENDSCHEIN, hereinafter referred to as the subdivider, is in compliance with all statutory requirements; and
WHEREAS, the subdivider has complied with all of the applicable ordinances and resolutions of the City of Oak Creek, except that the public improvements have not yet been installed.
WHEREAS, it appears that there are adequate assurances that the public improvements will be installed as part of the development of adjacent properties.
WHEREAS, the Plan Commission has recommended approval of this certified survey map.
NOW, THEREFORE, BE IT RESOLVED that this certified survey map, in the City of Oak Creek, Wisconsin, is hereby approved by the Common Council.
