       NOTICE OF COMMON COUNCIL ACTION

 

            The Common Council of the City of Oak Creek will on August 15, 2006 at 7:00 p.m., in the Common Council Chambers of the City Hall located at 8640 South Howell Avenue, Oak Creek, Wisconsin, to consider the resolution herein described and will act upon said resolution on August 15, 2006 at 7:00 p.m.  Said resolution was introduced by the Common Council of the City of Oak Creek on July 5, 2006, and proposes the discontinuing and vacation of an alley in the City of Oak Creek, Milwaukee County, Wisconsin, the legal description thereof being as follows:

 

A part of Lake View Subdivision in the SE 1/4 of Section 23 T N 22 R 5 E of the City of Oak Creek in Milwaukee County in the State of Wisconsin, described as follows:

 

From the NE corner of Parcel 1 of the CSM 3176 at the bearing of S89°05’39”E 60 feet to the point of beginning being the NE corner of Lot 29 of Lake View Subdivision Block 2.  Thence continuing along the same line S89°05’39”E along the south right of way line of Lake View Subdivision Block 2 alley way 204.98 feet.  To the NE corner of Lot 22 of Lake View Subdivision Block 2.  Thence SE along the platted alley way 7.07 feet.  Thence S00°52’09”W along the west edge of the platted alley way’s right of way line in Lake View Subdivision Block 2 for 101.22 feet.

 

From the east edge of Lot 22 of Lake View Subdivision Block 2 along the line of N63°34’19”W for 16.63 feet to the east edge of the alley way as platted in Lake View Subdivision Block 2.  Thence N00°52’09”E of said east right of way line of alley way in Lake View Subdivision Block 2, 128.60 feet to a point.  Thence west 19.92 feet at a bearing of N89°05’39”W to the most SE property corner of Lot 11 of Lake View Subdivision Block 2.  Continuing along same line west N89°05’39”W along the north line of the alley way as platted in Lake View Subdivision Block 2, 205.06 feet to the southwest property corner of Lot 5 of Lake View Subdivision Block 2, thence south 15 feet to the point of beginning.

 

Provided, that pursuant to Section 80.32, Wisconsin Statutes, such vacation shall not terminate the easements acquired and the rights of the public in any of the underground structures, improvements or services as enumerated or otherwise existing in said public way and in said description of lands hereinbefore described, but such easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if such public way had not been vacated.
