RESOLUTION APPROVING A PRELIMINARY
CERTIFIED SURVEY MAP FOR brett and tracy mEyers
(3rd Aldermanic District)
WHEREAS, it appears that the certified survey map submitted by brett and tracy mEyers, hereinafter referred to as the subdividers, is in compliance with all statutory requirements; and
WHEREAS, the subdividers have complied with all of the applicable ordinances and resolutions of the City of Oak Creek, and
WHEREAS, the Plan Commission, at their meeting of January 24, 2006 has recommended that this certified survey map be approved subject to the following conditions,
1. That a development agreement is entered into between the owner and the City specifying the responsibility for timing of all required public improvements.
2. That any technical corrections are made prior to recording.
3. That the final grading plan is approved by the Engineering Department prior to recording.
4. That the certified survey map is not recorded until the City has approved the flood volume compensation and has received certification from the Wisconsin Department of Natural Resources and FEMA and that all improvements are in prior to recording.
and
WHEREAS Chapter 14 of the Municipal Code requires that a development agreement be entered into prior to the required public improvements being installed; and,
WHEREAS Chapter 14.101(f) of the Municipal Code also requires that the subdivider of certain parcels enter into an agreement with the City related to the cost of future public improvements; and,
WHEREAS this proposed certified survey map is a redivision of Lot 2 of Certified Survey Map No. 6680; and,
WHEREAS Certified Survey Map No. 6680, recorded on July 9, 1999 provides a notation that Lot 2 cannot be subdivided to create additional lots taking access off of Puetz Road; and,
NOW, THEREFORE, BE IT RESOLVED that this certified survey map, in the City of Oak Creek, Wisconsin, is hereby conditionally approved by the Common Council.
BE IT FURTHER RESOLVED that by recording this certified survey map, the Common Council of the City of Oak Creek is rescinding the restriction placed on the further redivision of Lot 2 by the previously recorded Certified Survey Map No. 6680.
BE IT FURTHER RESOLVED that this certified survey map shall not be recorded until such time as a development agreement has been approved by the City and recorded, and the public improvements specified within the development agreement have been completed to the satisfaction of the City Engineer.
BE IT FURTHER RESOLVED that this certified survey map shall not be recorded until such time as an agreement is recorded relating to the cost of future public improvements for the parcels; and,
BE IT FURTHER RESOLVED that this certified survey map shall not be recorded until such time as the City has approved the flood volume compensation and has received certification from the Wisconsin Department of Natural Resources and FEMA and that all improvements are in prior to recording; and,
BE IT FURTHER RESOLVED that upon completion of the required improvements and the issuance of a certification to that effect by the City Engineer, a subsequent resolution will be presented for final development approval and approval of the certified survey map.
