Recommendation: That the Common Council consider granting a landfill license to Simon Krizan to place clean fill material at 9580 and 9878 S. Nicholson Road (Tax Key Nos. 909-9009 and 909-9999-002) (3rd and 5th Aldermanic Districts).
Background: Simon Krizan has applied for a landfill license to place clean fill at 9580 and 9878 S. Nicholson Road. Both parcels of land contain wetlands and floodfringe. The proposed grading plan does not disturb the wetlands and provides for compensatory storage at a ratio of 1.1:1 for fill in the floodfringe. The total earthwork volumes for both parcels include approximately 37,000 cubic yards of fill and 22,000 cubic yards of cut.
The north parcel (9580 S. Nicholson Road) of the proposed landfill contains 30 acres of land, of which approximately 2.5 acres along S. Nicholson Road are proposed for the landfilling operation and 2 acres along STH 100 are proposed for compensatory storage (total of 4.5 acres of disturbed area). The proposed filling along S. Nicholson Road will have a finished grade ranging from level with the road to 1.5 feet above the road.
The south parcel (9878 S. Nicholson Road) of the proposed landfill contains 23 acres of land, of which approximately 8 acres are proposed for the landfilling operation and 2 acres are proposed for compensatory storage (total of 10 acres of disturbed area). The average fill height is 3 feet.
Simon Krizan has requested the landfill license extend for a period of five years. If approved, the license would need to be renewed annually. Work on the north parcel is proposed to be done to completion prior to beginning any work on the south parcel.
The Engineering Department has reviewed the grading plan and finds it in compliance with the Municipal Code. An erosion control permit, land use building permit and a construction bond will be required should this license be issued. As-built certified grades and as-built compensatory storage calculations will be required upon completion of the work on each parcel.
Fiscal Impact: None at this time. The licensee will be billed for the actual city costs over and above the license fee for review, inspection, administration and enforcement if necessary.
